Don't envy them Lynk, they're getting paid to do it, plus they'll have some sort of spreadsheet set up to use for calculations, I have one too, and I think niggly has something similar in place, although his might be for loans. Credit cards as mentioned are just so darn hard to work out.

I only take my guidance from the FSA handbook but it's getting the figures is probably hardest for most people, unless they have all their statements.:D

OK, no longer having any sympathy for them then, wish they'd get the finger out and get mine sorted lol :D

Thank you, I would say the reason I was looking at these companies was laziness but its more like not enough hours in the day but I'd prefer the money in my pocket :o. What gave it away I work with computers ....:rotfl:

I'll take a look at the questionnaire. Is there anyone out there thats claimed from Dorothy Perkins or Wallis?
Yeah I know all about not enough hours in the day, I also work in IT, hence the unix reference!:p
Before my operation I used a dotty perkins card, nah only kidding, there's been loads of folks on here and hopefully some will be along soon to give you some assistance.
Have you thought of your reasons for mis-sale, on the ppi article, there is some good one's, if you're in a secure job with a good sickness/redundancy package that they probably didn't ask about, or perhaps you have pre-existing medical condition that they wouldn't have asked you about, and them having not told you about exclusions for that reason you were mis-informed, did they tell you it was better to be take the ppi so as to ensure you got accepted for the card, the list goes on.
    Hope this helps:D

I think someone posted that this was the quote they got from someone on the phone one day, they're getting work out of it, as alot of the banks employed hundreds to deal with the influx of complaints.

    I'm hoping mine's come soon!

  • Hi

Does anyone know if the 28 days the banks have to process refunds is set in stone and is it 28 working days?

I only ask as Black Horse told me once they had the acceptance letter (figures were enclosed with this) they have 8 weeks to put the money back in my bank, they received the acceptance on 4th August

    Thanks for any help

Some banks have been given 8 weeks to calculate and repay the money to you. Some others are only saying 28 days, but who knows whether they will or won't, they are making their own minds up as they go along.
Clydesdale who weren't part of the JR took about 13/14 weeks to make the decision, but when they sent the paperwork, this included the calculations and breakdown, when it was returned it only took them two days to pay the money into the bank, how they all can't do this I do not know.

    GUTTED!!!!

Received a letter from First Plus today which states that they are "unable to uphold your complaint"

Where do I go from here?

    I am so P****D off - I can't tell you!

They say that they had informed me of the cost, the payments, that it was optional yada, yada, yada.

All the reasons I had believed it was missold, they have disputed and said that I was told of all of them.

How can I get them by the short and curlies? I am fuming!!!

    :mad::mad::mad::mad:
What reasons did you give for mis sell?.

    Write back with this....
We/I believe we were mis sold the ppi on the above account number.
1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.

    2) We/I were not told that the ppi only covered us for 5 years, but the ppi would still be on the loan to term end with interest.

    3) We/I were told that if we did not make a claim on the ppi ,after 5 years we would recieve the ppi as cashback, and to look on this as savings plan.. But were not told that the ppi would be on the loan to term end with interest and the cashback of ppi would not include the interest that we paid over the 5 years.

In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included. This will entail:
    a) A refund of the monthly payments that have actually been paid towards the overall loan in excess of those that would have been needed, if the original loan had been sold without the PPI policy;
    b) Restructuring of the loan going forward so that the amount owed, the monthly repayments, the term and the charges reflect those that would have applied, if the original loan had been sold without the PPI policy.
    c) In addition, interest at the rate of 8% simple per annum to any excess payments made from the time each payment was made to the point that Firstplus pays them back to us. We/i believe we were not given enough information on this ppi to make an informed decision. Had we/i known the full cost of this ppi we would not have taken it.

Unless you can prove without doubt that this PPI policy was fair, reasonable and suitable for my/our circumstances we/I will require you to rearrange the loan as if PPI had never been included on the above loan.

If you used this letter,as i have posted this before, how did they dispute this????????.
  • I'd really appreciate some advice from you experts out there! I got an offer from HSBC today. The Personal Loan (PPI complaint upheld) was live, 64 payments made - 20 to go. They've offered a PPI redress (ie refund) plus taxable interest. Then proposed they would let me take it off the balance of the loan - only thing is: The repayments already add up to more than the loan+interest figures on the original contract. The outstanding loan balance has been quoted at 8K...how does THAT work except to swallow up more than the refund offered? Is this why claim companies thrive?
Do you think I should throw in the towel (I can give specific figures if anyone is interested)?
    Mills of thanks,
    SkeptiKat
