Hi! I have been watching this forum for some time now but have never posted before (hopefully I am doing this right). I would first of all like to thank you all for inspiring me to submit ppi claims. So far OH and I have had three successes totalling approx £16K for a joint loan, one Cap 1 card and one MBNA card all since submitting in June! SO A BIG THANK YOU FOR ALL YOUR ADVICE AND EXPERIENCE!!!!!
Interestingly though, with Cap 1 and MBNA we both had credit cards and we have both had one of them rejected, almost as if claims from the same address are being looked at.
Today we had a rejection from MBNA for OH, basically saying that their records showed that the application he completed in 1994 offered an option to tick the PPI thus making it clear that he could choose whether to purchase or not and that given the box was ticked and signed underneath they are satisfied that it was actively chosen and understood as optional. They say that at the time PPI was added to the account, OH was on permanent employment and that he has not provided evidence that he had any other adequate means of protecting his repayments, they have reached the view that the PPI policy purchased provided cover that would have been beneficial and they have seen no evidence of anything which would have changed his decision to purchase the PPI policy. This is their final response and they have advised to refer to FOS if still not satisfied.
For the last 10 years OH has been self employed though so presumably not covered.
Any advice on best next step would be greatly appreciated.

Sorry to hear this.
I understand that sometimes even a final decision can be changed, not that often but its been done.
You could ask them to reconsider on the grounds that you feel the complaint have been overlooked, and try giving them further information, for one, "the policy should have been made an option anyway, even if your OH did not have cover in place, if they had confirmed it was optional and made you aware you could protect the account by purchasing a stand alone protection elsewhere" these work out cheaper than the banks very own.
And who wants to pay more?
Ask them to provide you with a copy of the agreement if you no longer have this, check to see if its self ticked or ticked/crossed in bank ink.
If this is the case then your OH would have probably assumed it was all part of the package, I understand many did use to think that anyway, and if the staff were well trained enough then they should have gone through the policy with him to make sure it suits his requirements, and not just add it as if they wanted him to think it was all part of the whole package.
They did not sell the policy in your OH best interest.
Give them as much info as possible, if you want to ask them to reconsider despite receiving the final decision, ask if they could get back by 14 days of this request, and make them aware if you hear nothing or if they do not change the decision you will move on to the FOS.
(Of course you can complain to the FOS if you want to now).

After thinking for some while and reading the posts on here I decided to take on the banks and what fun it has been!!! Good news, received a letter from MBNA last week upholding my complaint against PPI, complaint was submitted in Jun 11. Only took one form and a email to the CEO (thanks for the details), now getting good old British pounds to the sum of 4725.11, loveeeeeeeerly! Still have 2 outstanding with Halifax and good old Lloyds TSB, both due end of Aug start of Sep.
Advice/help please. Now gunning for capital One and Tesco personal finance but I don't know the correct address; does anyone out there have it please?

I said to her i hadnt received a letter, or calculations....she said that the cheques & breakdown would probably arrive together..she was from the loans department & was just reading what was put on my file, as i had been ringing the ppi team for over an hour. She said the cheques had been raised but were going to another dept to be signed off before being posted, that, she said would take around a week. I did have a claims worker assigned to me who said last week he would email me when he had more info, however, he hasnt emailed me even though this info was on my file. I am going to ring/email him tomorrow & just ask why he hasnt let me know, unless he was waiting until they were ready to be posted, i dont know.
I really dont know any of my calcs, so i am unable to tell you how they came to that conclusion, but i am more than happy with it:j:j:j
I wouldnt know how much you would get back bud, give them a ring tomorrow & ask for more info....i was shocked this morning..i just expected them to say it was being dealt with..its been an anxious wait but as the saying goes 'every cloud has a silver lining':A:A

Sorry to hear this, but I would (even though the CEO have been ignoring your emails), email them again and tell them you don't feel you are being treated fairly and they have a duty to treat customers fairly and a code to follow, I would then tell them you will be contacting the FSA about this matter.
Not sure if it will help but they may get back to you quicker, I hope so anyway, good luck.;)

Hi there has anyone out there had any joy with yorkshire bank as i m currently trying to claim my ppi back from a credit card i had with them for 12 years , i closed it down about two years ago, at the moment i am at 17 weeks from the date i sent my letter to yorkshire bank, although clydesdale bank say they only recieved my complaint on the 18th of May. (they are dealing with yokshire banks complaints).
At the moment when ever you ring to enquire how things are going i always get a lady called Nicole who refuses to give any idea if your claim has been looked at or if there is any progress , its starting to get very frusrating. We have tryed to email the CEO over a week ago but to date not even a reply , the stock answer if not happy is to go to Fos!!!!!
Any ideas ? Has any one got any inspiration please ? I have a few claims in with other banks but Yorkshire /Clydesdale bank are the worst by far as they will not comunicate with you at all.!

I would send them a nice email quoting your reference number, no other details, and just say that you are disappointed that you have not heard anything from them since your claim went, in and that although you know you are entitiled to go to the FOS to complain about their service, you are aware that there is financial penalties against the bank should you do this, but that you don't want to do that at this time. I did this I got the usual crappy reply from the aqu.ppi address, but got contacted by a senior manager about 12 hours later from the ceo's email that had been sent, the following day my OH(in her name) got a call to say that an offer would be in the post in the next few days, this was only last week so we're giving till the end of this week and if nothing received we'll email the manager back.
Just for info their mail seems to take about 6/7 days to receive from the date that is dated by them.

I spoke to someone at HBOS today who told me that he had started working on complaints that were submitted on the 10th May 2011.
Mine was the 11th, so should be any day.
