Hi Mary, I sent my original letter around the beginning to Mid May too. They had written to me & said that they'd respond by the 31 August and obviously they have. I hope you hear soon & good luck!i wish my bank account could keep up with my Rockstar Lifestle! :cool:0 -

Well phonwed welcome direct who are dealing with my 2003 to 2005 loans , we are 2 days over the eight weeks . They said I should have a answer within 2 weeks. He also said I could now go to the fos but it would probably be better to wait the 2 weeks

Sometimes they do give you the opportunity to send further info in order for them to reconsider - as well as enclosing your rights of the FOS.

Their final response finally turned up in the post yesterday, and essentially they've said because I ticked the box to take out payment protection and that it would have been on a separate screen (it was an online application), it would have been clear that I chose to take out the insurance and that it was optional.
They also went on to say that I was eligible for the cover (on the basis I was employed and between the age of 18-70) and that I've not provided any evidence to show that I would've been able to cover the payments in the event of long-term illness or redundancy.
It also said that are not willing to deal with any further correspondence and have referred me to the FOS (leaflet enclosed)
Firstly, I never disputed the fact that I took the policy out - as obviously I can't have been 'mis-sold' the policy if I didn't take it out :rotfl:
Secondly, at no point in time have they asked me to provide any evidence of anything!
They also sent out a copy of the agreement I signed, however, the screen shots they sent showing my ticked box, refer to terms and conditions 1 to 16, yet the copy of the agreement they sent only has 1 to 3 which make no reference at all to PPI just to the card in general.
So, I rang MBNA this morning, and when I asked about the missing terms and conditions, she put me on hold, and then came back and said they weren't going to change their decision and I'd have to take it up with the FOS. I politely told her that I wasn't asking them to change their minds but simply to provide me with the terms they're saying I agreed to. Put on hold again, and then came back and said she would have to speak to her manager as these terms relate to the PPI agreement and these are not normally provided!

Thank you for your updated and again so sorry to hear this.
It would not surprise me one little bit if it was one of those opt out ppi already ticked for online, it's often missed about the opting out side of it, and it's also been known that online applications do not allow you to go on to the next question or page unless the ppi is ticked.
