PPI Reclaiming successes and failures

  • Hi all, just a quick note to let people know that even if you get turned down the first time with your PPI claim, carry on!
    I was turned down by HSBC after I claimed that being self employed meant that my "cardholder protection repayment" insurance (PPI equivalent) was missold as it wouldnt cover me if I couldnt work.
    To cut a long story short, I ended up phoning HSBC up and asking them to send me all the details on which they had made their decision (i am based in the Channel Islands so dont have the backing of the ombudsman).
    I suggested that i wanted to consult a lawyer and needed to see the same details that the ombudsman would want to see.
    They very nice guy said he would phone me back and within an hour I had an offer for £3341.
    This was all my dividends from 2005 onwards (they claim they dont keep records for any earlier than this) plus 8% compounding interest.
    I suspect i might have been able to get more if i had argued that the compounding interest should have been at the rates charged to me, but as this might have meant lawyers getting involved, i took their offer.
    So my message would be - dont give up if you are first refused.

    DONT play their games

    I would suggest an email to Barclays CEO expressing your disgust and making clear that

    A) you have already completed the FOS form and sent to them with your original complaint

    B) You do not accept the extenstion to the time line as the official deadline for them to address your complaint is 3rd October


    When did you start the claim against Barclays?

    I assume it was around the 1st/2nd week in June? (so the 3rd October is based on the new 16 week timeline?)

    If so, you MUST fight this as they will also state that once they make the yes/no decision, if its positive they have a further 8 weeks to actually calculate the amount and make payment

    Got a phone call this morning from HSBC saying we sent the request to the wrong address. The address we used was one given in our SOR first letter their wording:

    "The request for further information that you have made should be made to:

    UK Data Protection Compliance
    HSBC Bank PLC
    Griffin House
    41 Silver Street Head
    Sheffield
    S1 3GG"

    In this letter we do have the loan account numbers, the fact a PPI premium was paid on two certain dates for two seperate loans with the amounts. No premiums have been refunded when the product was cancelled (I got another loan which did not have PPI to pay these off).

    Reading these forums I think this is enough to put a claim in so did on Monday but applied for the further information just in case, just wondered if anyone else has had the same response or if we really need the extra information?

    When we put claims into banks to look into specific claims do they automatically look back further on old loans and credit cards that had ppi on them?. Thanks in advance. And well done to all success bods! xxxxx


    Hi there

    I don't think they used to, but it's possible they may do now since the Judicial Review, or they will go back to them at some point, but I would not guarantee of them doing that, so if you think you have a reclaim on previous loans, try to make a reclaim on them yourself anyway, good luck.;)
