agree but what annoys me is that some people on here if telling the truth are getting settled earlier just though it was be done on first in, a friend of mine had his settled after 6 months by fos so not sure what is the problem, some say it is to do with the company the claim is made against but not sure if that true

    Hi

I've been waiting since about April to have a result claiming mis-selling of PPI from Egg. I have emailed the FOS twice in the last 8 weeks and both times they state that each case is dealt with strictly in turn..............this is clearly not the case as i know someone who put in a complaint in SEPTEMBER who has had their complaint upheld and received a £4k cheque already.!!

As someone stated earlier.................GOOD THINGS COME TO THOSE WHO WAIT..(I hope)

I had mine settled with the Co-op within about 3 months in all and that was cause it was paid as "goodwill" and did not need to be adjudicated as then the company does not get a black mark against it with the FOS. From what I can gather when you send in a complaint the FOS then write to request details from the company and the company is charged too for someone making a complaint. Upon requesting these details some companies are quick in their response and also make goodwill gestures which is what happened with mine and its quickly resolved.

I know that some others like my complaint with FIrstplus first went to the Ombudsman and got passed to an adjudicator in July and then within 2 days later they told me they did not have jurisdiction over the complaint. I resubmitted it again and stated that they were members of the GISC and they passed it to another adjudicator who took the case on and then closed it again with saying that it was not within their jurisdiction. I have complained at this and have also asked for the fast track on it but I have now been told that my complaint (which is for unfair rebate) actually lies with the insurer and not the lender. FOS then told me this was under COMPULSORY jurisdiction and that my complaint would definately not be passed back BUT low and behold, they have now said that there are jurisdiction issues and that it has got to go to their management and it will be another FEW MONTHS before they know who to write to on my behalf. I have been asked to be patient in this. This complaint will take forever but I am not bothered as long as they hear my case.

My co-op one was only 3 months and I have been paid out too but its cause it was offered as a "Goodwill Gesture" and therefore did not need to be adjudicated as such. They actually made the offer rather than have the FOS go through everything with them. This is how some cases are bought forward. My other complaint is Firstplus and this has been backwards and forwards and got actually passed to an adjudcator in July and now they are telling me its a complaint that lies with the actual insurer instead as its for unfair rebate. I have now got to go through the complaints procedure again and up to yet the FOS are having problems telling me who to make this complaint to. I got an email on the 1st December stating that I need to wait another FEW months and they will get back to me..

They say they are still waiting for information from Firstplus and they do not give the company any time limits for getting back. It is up to the companies and also looks like its Firstplus that keep telling the FOS that they have no jurisdiction too.
  • Just want to say thanks to all at MSE for all information on site and templates provided.

I have (or had I should be saying) a loan with Halifax taken out 3 years ago payable over 4 years. I took my loan out at my local branch at the time, without your information I would never have known about the ppi fraud squad.

I was never fully informed about repayments with or without, or about the benefits or cancellation rights, I was not informed about legislation brought in last year regarding cancelation rights either.

I forwarded on one of the MSE template letters and within 2 weeks I received a letter letting me know that Halifax were sorry I was not happy and that my claim was being investigated.

About 2 weeks later I received a letter telling me that because I was a valued customer I would be receiving a refund for the ppi plus interest on amount due back, later that week I got another letter from Halifax telling me how much of a refund I was getting.

For a refund of premiums I was due back £860.80
    Refund of Interest £249.95
    Interest at 8% £140.70
    Total £1251.45

I was delighted by this figure but even more delighted with the fact that they paid off the remainder of my loan balance of £1922.42 as gesture of goodwill.

Thanks again to all at MSE for your information and also thanks to marshallka and di3004 for all the usefull information that I picked up on from all your threads.

Merry Christmas and All the Best to all.
