    Hi All

I have recieved a reply from Simply Be and they are not playing ball.. They state the insurance they provide is a "non-advised basis" which means they present you with the key facts, exclusions and terms and allow you to make up your own mind!! They have offered to refund £160 (last 6 months payments) as a goodwill gesture.. Considering i have paid nearly £1800 over the past 6 years i think this is pretty poor.

Do you think i should go to FOS or accept the £160??

    Nanna x

    Hi Nanna

DONT accept it - it is a try on / fob off - just think how many people will fall for this easy settlement.

Take it to the FOS if you believe you were mis-sold ,whatever your reasons were.
Did they tell you that you were more likely to be approved if you ticked the box?
Did they tell you it was optional or that you could get similar cover elsewhere?

I have similar knockbacks that have been upheld by the FOS.
Amex quoted the same bull ' we never advise anyone to take out such cover etc etc.
    FOS decided otherwise.

If you have paid £1800 - what about the interest that would also be due on top of the refunded premiums.....

At the end of the day ,what have you got to lose? a bit of time filling a form in and the cost of a stamp?

Fight 'em for the return of what is rightly yours.

    Hello
I have received a letter from NRAM with an offer to repay all the PPI on the numerous loans I've had from NRAM plus 8% simple interest, this is all good as it works out at £3200.
They went through all 5 (including my current) loan in chronological order detailing how much was paid and how much is to be refunded and its all there in black and white.
The details about my last a current loan read along the lines of 'we calculate your current loan to have a balance of £3076 , the balance as if you had never taken PPI on this loan. I spoke to NRAM today to get a settlement figure for this loan as the amount they are going to pay me is more than this so I can get the loan paid off, the settlement figure given to me was £3977, roughly £900 more, the advisor I spoke to said there must have been a mistake or miscalculation, I faxed a copy of that part of the letter to them.
The acceptance letter clearly states that once I have signed the form then I am legally bound to these terms and conditions, am I correct in thinking that this is legally binding for them to stick to the terms and conditions outlined in the letter EVEN if they have miscalculated (in my favour?) or can they supercede the letter with an corrected version for me to sign.
I have since signed the letter and delivered it personally to them (I have a receipt)
    Any ideas?
    Cheers

    Hi Matty

My reasons for miss sell were that i was in full time employment working for the public servicesmand that i got full sick pay and also that they didnt advise me that i could have got it cheaper elsewhere.

They have replied saying that they dont ask in depth questions and that me being paid whilst off sick wouldnt have made the policy void???? ( How, i dont know!!!) They also said they are under no obligation to advise anyone that cheaper alternatives may be available on the open market????#

So off to the FOS i go...

    Thanks for your advice :)

I have quite a few loans and credit cards going back the last few years, i was wondering if i would be better to get a 're-claiming company' to take over all of this for me? Does anyone know or have used any reasonable ones please?
I have started one off with the Halifax but i'm having a lot of trouble trying to get them to understand and also Barclays are saying they don't hold my records anymore!

Would appreciate any help/advice pls :)
Do not get defeatist when you think you have fallen at the first hurdle.

There is a great source of info on this site and you should make good use of it.

We cannot tell you not to use a company that is your choice.
If you do go with a company please make sure the ppi amount you may win will leave you with something paid back to you.

All the company will do is what you can do yourself, the only difference is the upwards of 25% plus vat that you will have to pay them.

If you need account details then SAR the bank these cost £10 each bank and they have to give all data they hold on you.
If you did internet banking then you may find the dd details (for loans) that show the account number.
If you have account numbers that is even better, you can claim just with this, the cc account is the card number.

This is easy to do and we will help you all the way.
  • Hi All, I've been reading through a lot of posts over the last couple of days and have noticed that there appears to be a theme running through some where Santander is involved. They appear to be rejecting a number of claims on store cards and then the ombudsman can do nothing because the sale of ppi took place on a date before the sale of insurance policies by Santander came under their jurisdiction.
    • Is this only for store cards?
    • What about old credit cards through Abbey or before (in my case an old National & Provincial account).
    • What date did they become regulated?

This seems really unfair. I thought the court case was to encourage these crooks to repay money they conned out of us in the first place. Its almost like a burglar getting away with the theft because you didn't buy the most expensive house alarm available.

This whole debacle makes me so angry. I have various accounts, insurances and a mortgage with Santander and if they come out with this crap I'll move the whole bleeding lot.

Good luck with this - you will need it.

I have been on to them today about the 8% in relation to an offer relating to a credit card PPI mis sell claim.
It was like talking to a robot, they could not comment on my specific case,I didnt ask for that just how they would calculate the 8% / when it would kick in as I belive the lenders offer is bending the rules to suit....just went round and round in circles with them reitterating the company line....I am no clearer now.

I do now believe they are erring on the side of the banks, now that the banks have started to bulk clear cases.....call me a cynic if you wish.

    Matty
Why should the FOS bite the hands that feed them?.

There are people on here who can work the 8% out, and know from when and to it is paid, they will help the poster more with this.

If the sale took place before 2005,then you go for the insurer for mis sell as the bank will not help.
When the insurer says no,you can then take it to FOS.

    Hi Anthony

    Well done on your success.

Did they actually provide you with a FULL detailed written breakdown?
This should show how it was calculated, for example, on an active loan, the amount of the loan balance if to settle and how they worked out the calculation to actually get to that amount, plus interest etc.
If they have not, the I would ask them to provide these to you, it's your account and tell them you're entitled to this.

You can make sure nothing is amiss, good luck.;)

    Hi Nanna

I agree with the others here, they are probably trying it on, maybe they will consider with any further information before you take it to the FOS, so if you've further info to give them I would send this and tell them your not happy with the offer, and would like them to reconsider this again on a more reasonable offer, tell them if you've heard nothing by 7 days you will then take this complaint further.

But of course you can make that move to the FOS now if you want to, good luck x;)

I would advise everyone to stay clear of these companies, i unfortunately have had to send a complaint to the ministry of justice regarding one company, not sure if i can name them? i have been dealing with them for 2 years, and its been horrendous
