I am wondering if the Information Commissioners Office will be able to help here:

Hello lovely MSE'ers!!
I've been lurking around since September when I had my LBM - I have been so inspired by you all and wanted to share my following success with you in the hope that I can, in turn, inspire others to keep at it!!
My OH is self employed, and as such should not have been sold PPI on his loan - he spoke to a really helpful lady at Egg at the end of October to discuss the fact that he believed he had been missold the PPI on his loan a few years ago.
We recieved a letter last week saying they hadn't managed to come to a decision yet but we should hear from them within four weeks.
Today my OH who is away workingcalled me to ask if we had had a letter from Egg as he seemed to have £800 sitting in his bank account from them...he was quite happy but a little perplexed because he believed that the actual amount owed to him was nearly £1600...so anyway I waited in anticipation for the post....
Letter from EGG arrived an hour ago...-
We had asked for £1597.13 which was the amount that my OH paid for the PPI

His actual loan balance was £1204.13
-
EGG have paid out today £2004.22!!!!! £1597.13 + £407.25 interest!!!!
The £800 in his current account was the 'spare' after they paid off the loan balance, which has immediately gone to pay off the total of my credit card balanceI just want to thank everyone who posts on MSE, you have given me so much insipiration in the last few months and without you I wouldn't have had a clue where to start!!
:T !!!Thank you thank you thank you thank you!!! :TAnd for those of you who are still trying to claim back your charges or PPI stick at it!!!!

Thank you to Money Saving Expert!!
E-mailed Alliance & Leicester just one e-mail, containing the template letter.
Within one week I first recieved a reply e-mailm stating my case would be looked at and they would contact me.
Then recieved a letter confirming an investigation of my claim.
Within 2 weeks recieved an offer of the full amount plus the FSA advised 8%!!
Truly amazing
I have accepted the offer and now just awaiting the cheque!!!!!!!!!!!
Can not say how pleased I am.

Cut a long story short after nearly 1 year Royal Bank of Scotland are going to refund my PPI at 8% per annum the loan has now finished. Could some one please do a calculation for me its a case of the A, B, C way working out the amount as i have seen others post about,
Loan-£5500
PPI-1488.14
Total of loan-£6988.14
Intrest-£2341.86
Total to pay- £9330.00
APR-12.7%
60 monthly payments-£155.50
It has been worth the wait and the battle but would just like to know how much they should be paying out, Many thanks go to this forum and all the help that it gives to joe public !
FOB have said i should get my refund in about 6-8 weeks !0 -

I told them if they did not cancel, put it in writing that the PPI had been cancel and pay me a refund for all PPI charges there would be trouble. This seemed to have done the trick.
But now I'm MAD! why did it have to come to that. But more importantly why did they keep taking my money for a service i did not want? Needless to say now put inmy claim to get the money back. After several weeks later i got a standard letter - ignore all the issues i started - to tell me that my PPI claim had been rejected. MAD, MAD, MAD!

If this was the first response then I would write back to them again and tell them if they do not uphold your complaint, you will not hesitate to take this to the Financial Ombudsman service for them to investigate with your evidence.
Did this letter from them mention anything at this stage about the FOS?
If so then complain to the ombudsman now, if not then write as I said above.
How long did they take to get back to you with the first response from when they first received your letter?
If for instance they replied within 4 weeks, then they have another 4 weeks to respond as they have the full 8 weeks all in all to resolve this for you.

i wrote to Lloyds as i'm sure i had PPI added to a £15k loan from them and they wrote back claiming i didn't. They claim they can't get any of the paperwork either, which i reckon is because they are trying to fob me off. Did you have all your original paperwork or did you just write to them in the hope of getting something positive back from them?
