  • Hi DI3004,

    Alas I dont know yet how to cut and past (nearly a silver surfer)!! The credit card was taken out in January 2005 and balance cleared around June 2010. initial letter of complaint sent to MBNA in July 2010, and have just forwarded to FSO today after receiving letter from MBNA saying its on hold due to the court case. Just cant work out why some claims seem to be being paid out on while others are being held up due to the judicial review?

    My complaint against LTSB in respect of a Credit card since 2004 began in November 2007. It went to the FOS in January 2008 and after 2 years, in January 2010 my complaint was looked at and upheld by an Adjudicator at the FOS. LTSB did their usual ostrich tactics and ignored the Adjudicators decision which meant i had to wait until an Ombudsman looked at it and hopefully forced LTSB to cough up!.
    I waited and waited and after another 10 months of follow up e-mails to the FOS and numerous standard issue fob off replies i finally decided to complain to the Chief Ombudsman/Chief Executive at the FOS about the time this was all taking. Two weeks later i received a reply from the CO/CE 's assistant who apologised about the delay and promised my case was on an Ombudmans desk and would be dealt with within 1 month. IF THIS HAPPENS that will be the first week of January 2011, almost exactly 3 years since it arrived at the FOS.
    I won't be derogatory about the FOS because they are trying to help but as with a lot of big organisations i think it really is the luck of the draw as to whose in-tray your case lands in and therefore how long it takes to be dealt with.

    Nov 07?? My god and I thought mine was bad enough!

    I just don't understand Lloyds, with my complaint (same grounds but my husbands has more basis than mine for a complaint) it took less than a month for Lloyds to credit my account!

  • Hi, With regards to ? how long the FOS process can take. My husband and I took out a large loan in 2005 and this was repaid in 2007. There was a very large single PPI payment added to the repayment and also taking into account the monthly payments we had made for two years the total is almost £18,000 - I have to take a moment every time I see that! The loan was organised through Freedom Finance and loan was with Wimslow. We were offered £1000 goodwill gesture by Freedom two years ago but we declined and went to the Ombudsman in January 2010 and were allocated an adjudicator in August 2010 - he has been very helpful and kept in touch with us every step of the way through numerous letters and telephone calls. We received the news that they are going to settle with us according to the recommendations and figures advised by the FOS and we have signed an agreement but we don't know what figure they are going to offer us - we have been told that this should be offered and settled within eight weeks but am very worried that they will come back with a low offer and we have signed. Anyone had any experience or knowledge of this? Thanks.

    hi, if you post up the following information i can give you an idea of what you should expect to get back.

    original loan amount
    ppi amount
    APR
    month and year the first payment was made,
    month and year the loan was settled,
    if you have the monthly breakdown between laon and ppi amount it would help
    the settlemenr figure upon early settlement
    and if any ppi was rebated upon settlement.

    one i have this i can work out some figures for you to give you an idea of what to expect back.

    The loan was for £67,000 and the PPI added was £18,090 . The monthly rate of interest was 0.678%. The monthly payments were £664.43 in total ( I'm sorry I don't know how much of that was PPI) and we paid this for 26 months and then settled the loan in full. The settlement figure in full was £86,469.06 There was an early repayment charge of £3,185 included in the settlement figure. We received no PPI rebated to us after this.
    Hope these figures help. Thanks in anticipation of any advice and figures.
