PPI Reclaiming successes and failures

Got my second knockback from my 1st two attempts....
This time from Amex.
Has anyone had any success with this lot?

And if so have they enclosed any details of the FOS?
I would keep on until you receive the final decision, otherwise complain to the FOS.

It doesnt mention 'final' decision anywhere,but it does seem to read that way.
They also state in the small prinnt at the bottom of the letter that I can go to the FOS etc.
I am going to send them another letter anyway responding to the points made(standard response no doubt - you have had T&C's and had 28 days to cancel etc etc) by them as they dont take into account all the facts.0 -
Hi, its now Thursday morning and I have received a letter from Eric Daniels (Lloyds head man) team. It would appear that they are still waiting to hear from the FOM (and they in turn are waiting to hear from Lloyds) and they recognise that this has been going on for years! I await now the contact to get in touch with me and we shall go from there.
I feel its a little step forward and thanks to you di3004 from providing all that information for me to get in touch. I hope it helps others too. Maybe this is the one now to clinch the claim and get it out of my life. Claims Financial by the way charge £150 plus VAT (are they waiting for the VAT rise on 1st October I wonder) to claim on my behalf. They have done sod all so far. Be warned anyone out there - do it yourself and dont rely on companies as they are just as bad as banks - have learnt through bitter experience!!!!
Anyway, I shall of course let you know what the outcome is - whether or not it is a success or a failure. I have two failures so far so maybe this wil break the spell. The other two being overdraft and council band reclaims.
Incidentally ggrant - this is a tale of how to get a success out of this - with the help of others who have experienced crap along the way. If you want nothing but successes then just blank out the triers and the failures and just read the good ones....of which I have to say are absolutely BRILLIANT and I so wish them all the best. ggrant - do as di3004 advises and get in touch with Wendy and then you can read nothing but wonderful, happy, joyous, bountiful success all day long.....................LOL

Hi all,
Looking for some help. Have just received final decision from HFC bank in regards to a credit card PPI stating that they will not refund. However, within the letter it states that 'the above account is a marbles account which was opened on 9 November 2004'.
the letter then goes on to say ' due to the amount of time that has elapsed I am unable to obtain a copy of the original application form from our archive department. Legally we are only obliged to retain this information for six years'.
November 2004 + 6 years means they have to keep this application until November 2010?? therefore am I right in thinking they are in breach of the FSA rules???
Has anyone else had anything similar,, and if so any ideas as to the best next step??

Your welcome.
Your doing the right thing here.
They will mention about the FOS, as you have rights to do this now, but they MUST enclose the leaflet details of the FOS in the final decision.

Good point made there, as its not exactly hit the 6 year deadline really yet has it?
I would so as amersall says and maybe give the Information Commissions Office (ICO) a ring and see what they also suggest in this case.

Sorry, probably didn't make myself clear. They state in the letter that 'I can confirm that PPI was applied when the account was opened, as this was requested by you during the application'. Now I am confused as to how they can say this given the fact that they then go on to say that they do not have a copy of the application form......

Contact the ICO (I posted their details above) ask them for advice on your data.
You could write back to the HFC and ask them what proof do they have that actually confirms what you were informed in your letter and make them aware that you are to contact the ICO, or if you have already done so by then.
They must have these details somewhere - to have given you that information.The one and only "Dizzy Di"0
