    That is exactly what we think too. Why offer anything if you think you have done nothing wrong. I was also told that this rebate would be taken off our loan amount which as someone has already said is simply a re-adjustment of their figures. We are 17 payments away in theory from getting the ppi back in their cashback scheme, so in taking the enhanced rebate we would be losing out anyway. Everything is turned to their advantage, and I think that it is morally wrong too. They leave us little choice but to pursue for the whole amount as 17 months is a long time paying for something that was mis-sold. Who ever nicknamed them "Worst Plus" on here is a genius. Without sounding naive can anyone tell me what a SAR is?

    Am new to posting on this site but have been a fan for sometime. In 2004 we (DH & myself) took out a secured loan with the now infamous First Plus! We too like so many were mis-sold a single premium policy of a whopping £14571.55:mad: . In 2005 we remortgaged and were shocked by the ridiculously high redemption figure ,as it was never made clear to us at any point that the ppi effectively secured a further debt against our home because of the way it was front loaded onto our loan. Inspired by this website we contacted First plus at the beginning of march this year regarding the mis-selling on a number of counts. Like so many others we got the first response that said go away. Their second response which we received yesterday was the standard 78% enhanced rebate rubbish as a gesture of goodwill:rolleyes: . They offered us £3093.77 which would be taken off the loan and our monthly payments will be reduced by a few pounds. They really are quite incredible. We are 43 months into this loan.I rang our "Complaints Executive" who ran through this with me. She said it was their full and final response yet admitted she hadn't heard the taped call as they couldn't find it!!! I feel so strongly that they are not being fair so need to ask for some advice as to what to do next. Are there any more avenues to explore before we contact the FOS?

    it shouldnt be there final response if they cannot find proof of the call at the end of the day they have to proove it wasnt misssold and they cant call there bluff tell them they need to find a recording and you want a copy

    can anyone tell me what a SAR is?
    It stands for Subject Access Request I believe, It is the request of all documents and taped telephone conversations in relation to your loan application. The loan provider is bound by law to give these details to you if requested and is not allowed to charge you more than £10 administration charge for it.

    Hi. Sorry for long post.

    Dont know if im in right place.

    Going after Empire, Great Universal and Littlewoods Catalogues for mis selling of ppi.
    Have wrote to all 3 with the template letter, had a reply from 2 of them (Empire and Great Universal) basically they both say that as the account cover was taken out before the were regulated I can go take a running jump and dont have a leg to stand on. The both said that dont bother writing to the FOS as because they werent regulated befor 2004 (account cover added before 2004) the FOS will not investigate. Empire even hinted they were above the law.

    I replied to the both of them that I knew they had mis sold the account cover because I was not working and would never have taken out the cover (it was just added to my monthly statements one month and as I never had any paperwork I thought it was compulsary) even sent them proof of Carers Allowance benefit via a copy of a letter from DWP (been on carers allowance since 1994).

    Great Universal even said in their letter that I took it out when I opened account, I didnot the account cover didnt exisit in the early 1990's.

    Littlewoods havent even acknowledged my letter.

    I owe nothing on any of teh accounts now but have paid hundreds of pounds in account cover over the years.
    What is my next move?
    Graet Universal admit they have no paperwork regarding my account cover beacuse they say it was taken out over the phone and the sales advisor would have used a sales script to make sure that the cover was suitable. Did not phone me because if they had obviously they would have known the cover was unsiutable I was on benefits.

    This is the letter this morning received from Great Universal

    "As we have previously advised as we only hold information for six years I can confirm that you have had the benefit of the cover from March 02, and had you made a valid claim which would have satisfied the terms and conditions of teh policy, whilst your cover was still in force, thos woud have been accepted and as such you have had the full benefit of the cover should you have met the criteri needed to make a claim.

    I trust that our explaination meets with your satisfaction and confirm that this letter concludes our investigation into your complaint.

    As your policy was sold before 05/11/04, unfortunately you are unable to refer your complaint to the Financial Ombusdsman Service as we were not a member of a Dispute Resolution Service until this date. I feel it is appropriaate to point out that, if you do decide to refer to FOS, it is unlikely that they will consider your complaint. However they will require you to confirm that we have issed our final response, and to that end you may consider this letter our final response".

    In my last letter to them I said I ws going to take them to court and they have ignored that.

    Looking for advice on where to go next?

    Maybe a SAR and then file in court.(i am willing to go that far)

    Not sure if anyone can help me with this.
    I am currently reclaiming my PPI plus interest from Lloyds TSB.
    I sent the letter by special delivery about 6 weeks ago. I had an acknowledgement letter from Lloyds, saying they were looking into my complaint etc etc.
    Then on Friday, I had another letter from them saying that it is likely to take another few weeks to give me a final response. Does anyone know if there may be a reason for this? I heard that an investigation from the Competition Commission into PPI is due in the next couple of weeks or they simply waiting for this? Is getting this kind of letter from them at this stage part of the usual process?
    Really annoyed because a lot of people have just had thei premiums automatically refunded...

    If anyone could give me some thoughts that would be great. Thanks.

    Well I have regrouped and feeling bit more positive now, phoned FO this morning and the adjudicator that was dealing with my case has left the company, oh thank you for letting me know, anyway I now have to wait for a new adjudicator to be assigned to carry on the work, that alone will take another 2 weeks or so, oh what joy but at least something is being done, I will just have to wait and see, surely with so many mishaps something must go right in the end (fingers crossed)
    Claimed back almost £4000 so far from HSBC for mis-sold PPI
    £2083.00 + £242.00 8% interest from FirstPlus and lower monthly premiums:D Studio Cards paid off my account and gave me £125.00 in gift vouchers. £500.00 Barclays.

    Hi, I am going after the same companies and more and have been fobbed of with the same answers as you are getting, but one has paid back (littlewoods) as a gesture of good will of course. With the others I have just sent another letter to them asking the following;
    # Who were you regulated by at the time the policy was taken out.
    #Can I have copies of the paperwork proving that I was not mis-sold with telephone transcripts if possible( the onus is on them to prove that policy was not mis-sold)
    #A list of all charges on the account.
    #The name and address of their legal dept for future correspondence.
    I finally reminded them of the misrepresentation act of 1967. They have not yet responded but I have not yet got a fob off letter after 7-10 days as before so they are either taking me serioiusly or ignoring me, i will let you know!!

    Hi there!

    I have several cards and loans I'd like to claim PPI back from. They include a loan and a credit card with Natwest, plus a loan and credit card with MBNA.

    What I'm not sure of is if I should send claim letters for the loan and credit card at the same time. Not sure if Natwest has the same address for their credit card that they do for the loan, and the same with MBNA. Maybe I shouldn't care what they think about recieving 2 claim letters at once!

    I'm sending out a letter to GE Money tomorrow and will be doing the same too with Capital One.
