PPI Reclaiming discussion

Amber-Leaf wrote: »Hi
Can anyone give me some advice please...
My husband took a loan out with LTSB in Feb 2002 for £4300 plus a "one off" insurance premium of £1070.05 plus interest.
I have followed Martins template on reclaiming missold PPI and the points raised were that my husband felt the salesperson was pushy in selling the PPI and also that the salesperson implied that taking out PPI was essential for my husband to get the loan.
LTSB replied today saying they have relevant signed paperwork by my husband to say he has agreed to the optional loan cover and that it was up to him to cancel this within 30 days of taking out the loan, although they advised him to take it out to get the loan in the first place!!
They are more or less saying that they feel he was not misadvised about the optional loan cover as the correct procedure was followed by LSTB and they have signed documents to say my husband agreed!
Shall i now send the second template letter or not bother??
Any help appreciated
Thanks
Amberleaf
I'm in pretty much the same situation with LTSB as you seem to be - I've had a similar reponse (eventually) from them, They said that I had signed the paperwork (which I never denied anyway) and say that they have followed procedure therefore do not feel I was mis-sold - but I don't feel that it answered my complaint re: pushy salesperson etc. Did they say in their letter that if you are still unhappy with their decision that you can contact the financial ombudsman? They did in mine, but I wonder if it is worth sending them template No.2 first?

Lloyds have just refunded mine as I too felt the salesperson was too pushy.
Good Luck
Hi, How many letters did it take to get them to pay up - I'm in exactly the same position and don't want to let them get the better of me!! Cheers, K.0 -
Any advice plzzzzzz, that would be great and if anyone has had any dealings with Picture Finances if they could let me know how the got on with them.

I really don't know the answer for you but can you claim that you were pressured into taking their PPI as the above posters are talking about?0 -

What kind of tactic do you think alliance and leicester are upto? Is there going to be an law change soon or something or have I got nothing to worry about?0 -

I have written to three credit cards that I opened 1999-2003: MBNA, Lloyds TSB and Morgan Stanley (now Goldfish). i went through a very nasty divorce a few years ago and used the cards very heavily and in consequence paid considerable interest and PPI. At the time I wasnt even aware i was paying PPI, although in hindsight it is on the statements! Having kept the statements the total amount spent on PPI over the cards is about £2000.
Having read Martin's site I wrote to all three companies claiming general misselling, as I wasn't even aware (until I read the site) that I was even paying PPI. I also had very generous employer benefits at the time and wouldnt have needed PPI.
All three took months to reply but have all now replied denying any misselling and enclosing copies of the original agreements. In all three cases there is a box asking for PPI that they claim I ticked. I can't deny or confirm whether I did or didn't tick this box.
My question is given these copies of the original agreements is it worth proceeding any further with these claims or have I fallen at the first hurdle.
many thanks
I have the same problem, I don't know if I ticked these boxes or not, I know that the cover was not explained fully and no attempt was made by the company involved to ascertain if this cover was neccessary but they have a copy of an agreement where the PPI box has been ticked, I don't see how I can take this any further. Any ideas, anyone?

i also have this problem ( although one account was where the tick was already included) so can i bump this for advice please
Hi all,
Still wondering if I have any grounds for taking these further as others seem to be in the same boat.
Many thanks0 -

I sent the 1st letter asking for PPi back on the grounds the salesperson was too pushy. I got a response saying it was being referred to their Insurance guys who in turn replied within 3 weeks saying that they would refund the premiums, plus interest, direct to the loan accounts. This was a goodwill gesture - they did not admit PPI was mis-sold. I asked for it to be paid into my account rather the loans but they held firm and said it was their policy to pay it into the loan accounts. Rather than it to drag on I accepted this so one loan has now been paid off with the credit balance being paid into my current account, The balance on the other loan I have with them has shrunk so rather than it finishing in 15 months it will be finished this year instead!!
This was much easier and quicker than claiming the bank charges back with them!! I guess I was lucky on this one having read other threads!
Good Luck.Lloyds (Bank a/c) £2101.76 :jCapital One claiming £933.17 inc interest Halifax Card claiming £1143.75 inc. interest - £450 accepted as part payment only

Hi
Just wondered what my next step was. Can I now go back to FP and say that they were regulated back in 04 and they were using companies that were not regulated (Central Trust) so cough up.
I also need to go back about the unfair rebate but want to do it in 1 letter.
Thanks
Claire
I have my 3rd letter to FP for the 78% rebate and also for the PPI see what response I get.
Next one will be to the FOS.
Thanks

Hi
Had my response from Capital One.
It says that I was sold PPI and the terms and conditions were not sent out to me.
However when they realised this (after the fine by FSA) then they submitted these to everyone.
They are saying the Capital One are not allowed to advice anyone to take out PPI and that the decision to do this was purely mine.
As it was on my monthly statement, it means that I was aware that I was being charged it and because I had not attempted to cancel it.
Therefore they will not be refunding any payments.
Again is this correct?
Thanks
Claire
I have sent my 3rd letter to Capital One. I have asked my for the documentation with my signature on it. See what they come back and say.
Thanks

Hi' i new to posting here so please tell me if i'm in the wrong place.
My mum has had 2 barclayloans over the past years and always paid ppi. She doesn't have a job and is classed as a housewife on the application forms. It states that if she doesn't have a job ppi would not pay out in the event of her being unable to make the payments so should she have been sold ppi in the first place. 1st loan maybe over 6 yrs ago. Can she claim ?
