    Hello Sam2349
I also have had an EGG card since March 2000, I have found my copy of the credit aggreement and also a copy off the PPI terms, I have read through it and there is no mention of the PPI being optional and my signature is only on the credit aggreement copy, so you would think we should have a case for mis selling .

Did anyone else start off with the Boots Advantage Credit card which was automatically changed to the EGG card?

I am off to see if I can dig out old paperwork (I don't usually throw much away to do with finance so must be somewhere)

    Golden Rule Number 2:

All post sent by yourself to be registered. For the cost of a couple of pound you have confirmation of receipt and a name. In all case this means that someone acting on behalf of the company now becomes directly responsible. Post can't get lost and inaction on their part looks bad if you can prove they had it for a long period and done nothing.

Have just looked to see if you should have received notification of your boots card becoming an EGG card. The only thing i can find is that the Boots Advantage Card was launched in conjuction with EGG. Ie its always been an egg card. The only hope you have is if you can prove that your terms and conditions have altered from your original agreeement with no notification of the change.

sorry this was the only success story i could find on co-op but it relates to bank charges. All i'll say is grit your teeth and keep going as its worth it.

    Hi,
Plase can someone advise me if i have a case for mis selling here.
I got a loan out with black horse in my name only. i was pressured into agreeing to the PPI with the salesperson telling me, no PPI, no loan. I got the loan in march 05, paid it off in Nov 05. I have recently got hold of the agreement & noticed that although the loan is in my sole name, the PPI is in my husbands name, even thought he wasn't even present when i signed for the loan. How the hell would that have worked had i needed to claim on PPI? I am fuming about this, as well as their bully boy tactics. I have written to them a few times & though i've had letters saying 'get lost', we are not paying you out, they have never actually addressed my question or provided an explaination as to how i would have stood if i'd have had to claim. Am in the process of filling in forms to take to the FOS, see if they can get any answers. What do any of you guys reckon on this, would i have been able to claim or not? Thanks.

Hi just to let you know i have successfully taken black horse to court twice now. Don't bother with the FOS if you have clear proof that they mis sold just go down the MCOL route. You might get a letter from their solicitors but bare that no heed and reiterate your case to them. You'll be surprised how quickly they back down rather than go to court.

It is so frustrating, in my policy it states that the definition of unemployment is not in employment and claiming job seekers allowance. I really don't plan on claiming JSA for 180 days! I'm gonna sort the letter and send it tomorrow and keep my fingers crossed. I'll keep you posted.

Hi have just read your post. Reinterate your case and send them a letter deeming it unfair in particular to the Unfair Contract Terms Act 1977. In particular to section 11 the reasonable test. Ie its unfair to assume that a person will be unemployed for 180 days if given unemployment after maternity leave. Heres a quick link so you can see what i'm on about:

    Hope this helps.

Right this point you can be proactive. Phone them up using your reference that they gave and ask if a response has been sent out. Get them to read the gist of the letter to you. If no response has been sent tell them that they are in breach of their own deadline and you will now expect a response within 7 days (if outside the 40 days) and if non is forthcoming you will immediately inform the information commisioner and raise the complaint with the FOS/ or take it too court as you haven't decide which course of action and are currently seeking legal advice on the situation. Then give him a reference of your own making noting it down of course and ask him to send a letter confirming that you had a conversation for that said date. Sorry forgot to mention get his name (full if possible or employee number) and say you will be writing a letter to confirm the conversation.

Thanks for that,lm surprised at NW,if it was ge money now that l could understand!! What made me laugh at NW was that the first letter l sent was replied to by return of post saying they had done a thorough investigation into our claim (yeah right!!)this second letter's taking ages, But thanks will do what you suggest.
