Hi,
I have just received a letter from MBNA advising they will not refund my PPI as they think i did request it. They have stated this is their final response and if i am not satisfied to go to FOS.
The reason I want my money back is because I know I tried to cancel my insurance on 2 occasions but it did not happen. First time they were very pushy and I felt ncomfortable with the phone call and the 2nd time I was told it would be stopped only to later realise it had not. I do not have any evidence to back this up so is it still ok to go through FOS?
Any help appreciated.0 -
angelwillow wrote: »Have written to Capital One several times about my partners credit card account asking for them to return ppi from when he was signed medically unfit to work and they still charged him for it despite us letting them now he wasn't able to work.
They keep sending the same standard letter of 'we sold it fairly and you had 30 days to see if it met your requirements' etc but this is not the circumstances I'm querying as he wasn't deemed unable to work within the 30 days!
Now we get today a letter saying basically stop bothering us as it's our final decision despite them not addressing our concern and ignoring our request for proof we even agreed to ppi in the first place.
Unfortunately this was 6 years ago and we 'stupidly' didn't realise we could possibly claim it back until reading this site. So my question is can we go to the FO or are the time scales wrong ie were Capital One 'answerable' to them that long ago?
Any help would be much appreciated.
Now concerning my account they have said they "will not provide copies of phone conversations or the script that is used".
Any help on either of our cases?0 -
Just wading through all my paper work that egg have sent me and noticed that a loan that i had with them in 2003 for £15000 had PPI added to it £1203.30. Grand total of £16203.30. I am going to claim for misselling as I didn't need it. I just wanted to check with you lovely people first though because, 2 years later I paid off the loan by taking out another loan with them. The thing is they never gave me a rebate on the PPI. I borrowed a total of £29428 to which they added £5700 PPI total of £35128. Apparrantly they couldn't give me the loan as one so made it into two loans of £17564 including the PPI.
Later that year I took out a consolidation loan and noticed from the statements that they cancelled the PPI and added it to the two loans. Hope i haven't lost anyone!!!
My questions are,
1. Do I have a case for the £15000 loan and if so, what should I be asking for?
2. Even though they paid back the PPI into the other loans when I settled them do I have a case or should I just leave those ones?
You've helped me in the past for which I am very greatful.0 -
Hi guys, I took out an egg loan, and have 2 of their credit cards too, my hubby has a loan & card with them too.
I remember with the loan being told we had to take the PPI or we wouldn't be able to get the loan, so we took it, but went for the longest option - 180 days before payout. Therefore when we did need to claim (hubby lost job), we couldn't because he was back in work within 2 months.
We are now on a Payment Plan with CCCS, so not paying the full payments to Egg, just what we can based on earnings and outgoings. Are we still able to claim based on being mis-sold policy, or as we're not paying full payments would they say "go away".
Interest has been stopped on accounts, but I don't think the PPI has been cancelled or credited, so we're still paying for it, but I assume we wouldn't be able to claim against it!

Hi i think maybe you should wave first of all the letters in which they refer them too you and also use the data protection act what allows you access to all information about you held by any company (including tape recording's:D ). Be very firm on this and tell them if they don't comply to will going to the information commisioner and the FSA due the fact the company is breaking the law.0 -

You can still claim whether or not in debt as you can prove that this PPI may have been a contributing factor for you going into debt. Also posted on the previous page is a link i put in reference the unfair terms and conditions of the PPI
http://www.johnantell.co.uk/UCTA1977.htm
This refers to the fact that you felt ablidged to take the 180 day policy because it was the cheapest and they knowingly sold this too you knowing that it was nigh on impossible to claim.0 -

If you check out the FOS/OFT/FSA websites you'll see information relating to dispproportionate rebates. In most case's all consolidation means is they get to rape you again. I would send the documentation to the FOS siting that you believe that EGG have delibrately not refunded the PPI in these policies and their rebates are disproportionate to the actual amount already paid.0 -
hI,
What is the rule on how long a company has to hold signed contracts??
Also, i believe ifthe mis sale event happened more than 6 years ago, then you are unable to take it to court as the or 3 years to be reasonably aware rule" does not apply. Do you know if that is the case?
Thanks in advance.0 -

Have you got dates and times in which case pull out your phone bill and find the number as what other reason would you have for phoning them. Its a bit tenous i know but its the old adage the horse has bolted why shut the gate. Thats why always send letters to back up phonecalls so they can't ignore them. If you could get copies of these phone calls it may assist your case.0
