After they decided that I would accept their crap offer of settlement they cancelled my insurance, paid the money into my loan and re-structured my payments. I complained and they put it all right again - apparently. Well they obviously haven't as they've taken the direct debit of the reduced amount. So I rang the guy up (who fair enough has been helpful and very nice) and he assured me all was okay but can't explain why the DD amount is wrong. I've left him trying to make sense out of it!
On the plus side they are REDUCING THEIR INTEREST RATES!!!!!! From April my payment will be less per month - though I haven't received the letter stating this (he just told me on the phone). He made no comment on the FOS form I kindly sent to him for reference though
Hi stillsmiling just one quick question although you accepted their offer of settlement did you agree to the method of the settlement? ie did you agree for them to pay it off your loan as you may be able to get them to recant and repay you the money in person (better in your pocket then theirs) plus their rebate may not have been in your favour. Check the FOS website on disproportional rebates against loans.0 -

You misunderstand, I did NOT accept their settlement. That was the problem. THEY decided that I had accepted it - despite me telling them that I was not happy with it, would not be signing any of the paperwork to accept it and would be taking my case to the Ombudsman!0 -

Ok easy solution get your husband to phone initally and then log that you will be dealing with the situation from now on. They can't ignored you then. Keep on fighting nova you WILL win it just takes a lot of patience and determination. Remember what i said don't get into discussion's with them as they will only try and upset you and put you off. From now on only deal in letters. Wait for them to try and contact them and then take grate pleasure in not talking with them. Play them back at their game. If you have the paperwork and it's after the time frame/or you received their final response take it to the FOS/court and send them a copy (politeness never hurts) then wait for their response. :rolleyes:0 -
They are going down (first plus ) ...My reduction is from 9.7 % to 8.7 %........saving £50 a month!!!
OMG i need a drink!!!!!!!!!!!!!!!!!Julie:p0 -

Oh Thank you, you're great.l did try and keep my cool its so hard though especially when the person who you're dealing with is about 5 years old!!!or sounds it.l think maybe l'll try the court route as FOS are snowed under by the sounds of things.l shall follow your advice and thanks again,See, if l didnt have this site l would have sat here and grizzled!!0 -
OK don't get yourself upset. Sit down with a nice cup of tea (not patronizing). Start by listing your cards and your accounts working backwards from today. For each of those cards and loans which were active within the last six years send a registered letter requesting your customer credit agreements on those accounts also request copies of all phone conversations relating to loan applications made. This is basically requesting information about yourself which they must release to you under the Data Protection Act (Information of a personnal nature relating to you). Now armed with this information start drafting out letters of how you were mis sold espcially relating to either the Misrepresentation ACt 1967 (They negligently mis sold you a product which was not in your best interest to have) or the Credit Consumer Act 1999 which refers to company's over relying on postal documentation rather than explanations. Also reference calls of application were you can highlight tone or lack of information provided. If you don't receive the information within 40 days then go to the information commisioner and raise a complaint against the company. Once the 40 days are up either progress the claims through the FOS or FLA (check the FISA website to confirm whom were members of what) or via MCOL. Don't get into protracted phone calls with the companies *i repeat don't do it* get them to correspond via letter as it will save you a lot of trouble and grief. Lastly everyone on this thread has been in the same boat and we all are behind you 100 percent so don't get down start fighting back.:A
Many thanks for your kind reply....I was dreading no one answering. I've printed off your advice and I'm going to follow it.
I'll keep you informed as to progress.
Thanks again
