:beer: KERCHING....KERCHING....KERCHING :j Hi all just couldn`t contain myself and had to let you all know..Had a letter back from the Halifax this morning,
"Having reviewed your account carefully I am satisfied that your policy was inappropriate for you because although you also signed the application form,one of the separate boxes relating to the purchase of repayments insurance also required a signature to confirm whether or not you required protection for the loan repayments however both boxes were left blank.
This should have been identified at the time of the interview.You did not sign that you did not require the cover and the documentation is therefore not compliant with regulatory requirements for the sale of the cover.
We will arrange for a refund of the insurance premium plus interest to be made :T

rang HSBC today to ask how they were getting along with my claim. reply was that they are awaiting more documents but still have 4 weeks to deal.
I said "no you have 2 weeks to deal" they said that as they did not rec'v the complaint until 31st jan thay have 4 weeks to deal. Advised them that my original complaint was made by emailing a person direct on the 17th jan and as he had not bothered to reply i sent 2nd email on 31st along with a copy of the 1st email. They again say that as they did not have it until 31st jan 4 weeks to deal.
I said oh if thats what you say then and left it at that. I then rang the FOS to complain about this & they are sending them a letter to say must deal in 8 weeks from original complaint 17th Jan. :rotfl:
Also explained what the complaint was etc so at least they have that also
I also email HSBC complaint dept on 17th jan.
got an email next day confirming received email.
got a letter on 15 feb saying they are looking in to it.
got a letter yesterday saying they are upholding my complaint!!
BUT - they state they cant just cancel the PPI and a new loan needs to be taken out "at same term and interest rate". they will not release the money to me unless this is done and if it is not done by 30th march then the offer needs to be "re examined"
so what do I do? its nealy £3000 which I could really do with but I dont want to take out a loan to pay off old loan with PPi and interest and end up paying more.
do you think if its at the same interest and term that it will still work in my favour?
at present owe £18171 with monthly payments of £349 with 5 years left. will they take off the ppi of £4995 before they make me refinance it? or will I have to take a loan of £18000 then pay interest on that?
original loan was for £18000 3 years ago!!!!

Have written to Capital One several times about my partners credit card account asking for them to return ppi from when he was signed medically unfit to work and they still charged him for it despite us letting them now he wasn't able to work.
They keep sending the same standard letter of 'we sold it fairly and you had 30 days to see if it met your requirements' etc but this is not the circumstances I'm querying as he wasn't deemed unable to work within the 30 days!
Now we get today a letter saying basically stop bothering us as it's our final decision despite them not addressing our concern and ignoring our request for proof we even agreed to ppi in the first place.
Unfortunately this was 6 years ago and we 'stupidly' didn't realise we could possibly claim it back until reading this site. So my question is can we go to the FO or are the time scales wrong ie were Capital One 'answerable' to them that long ago?

Well, you're gonna love this one.....
Apparently I had to be redundant for 180 days before I could claim... This annoyed me , but as I was pregnant and the company paid my maternity with the redundancy I waited 180 days and then submitted a claim, only to be told that I needed to be on Job Seekers Allowance for 180 days too! Which I have only been claiming since 2nd Jan, as that is when I legitimately started job seeking.
I got a letter this week saying that they would pay out on 1st July 2008! If I haven't got a job by then I'll be very p'eed off!!!!
I have called them and told them to cancel my claim, so it's not on the system as an open claim which might effect trying to reclaim some money. They closed it and said it could be reopened if need be.0 -

That is absolutely disgusting,you should be able to have an insurance policy that actually pays out when you need it,it seems it doesn`t pay to be honest with these people either which is what you have been.Does it definately say in your policy details about being on job seekers allowance?I really can`t see what this has to do with them.Have you checked your policy?Sounds ludricous...No wonder your fuming,so am I:mad:The Grass may look greenerbut it`s always going to take just as much mowing
