  • Hi All
I have just recieved a letter from Egg credit card in response to my letter sent last week.
They have replied saying that I am not entitled to any money as when I applied for the credit card online I choose the box say that I accepted the PPI and they could not fill it in for me. They sent a copy with this application form showing this.
Is it worth continuing with the second letter and so on.

Hi, the exact thing happened to me. They sent copies of the screen that I was to have completed. The only thing was that on close inspection the employment details were incorrect as they showed my home address as my place of work! I also was not aware, and couldn't see on their print, any opt out button to click! I sent them second letter just over 2 weeks ago stating all these things, but they have still not replied:mad: . Will post today a reminder and if they have not replied by this time next week I will refer to FSO!

    Will keep updates posted.

I previously posted about my current progress with Barclays... Link: http://http://forums.moneysavingexpert.com/showpost.html?p=7872653&postcount=1949

They eventually sent a letter stating that the PPI was of "minimal cover given the circumstances" and they will be making a full refund of the insurance premium together with the associated interest paid on it. However, they had also stated that in order for them to do this, we would need to apply for a new unprotected loan, which is then used to repay our existing loan, the PPI amount therefore being used towards reducing our loan amount payable. They had stated that the offer was valid for 30 days (letted dated 10 January).

However, I then sent them another letter rejecting the offer made, stating that I wished to have the money refunded to me and a request to adjust the future monthly loan payments to exclude PPI. I have now received a letter stating that they had not infact admitted fault, but had stated that the PPI would have been of "minimal cover". They have also stated that as we have rejected the offer made to us, they are now requesting details of how we would like to repay the outstanding balance of the loan, and if they don't hear from us this week, they are assuming that we no longer wish to pursue the matter, and we will basically be back at square 1.

Can someone now advise me on what to do next please? I just want the matter dealt with and out the way now. Are they within their rights to insist that the PPI refund is deducted from the loan amount I owe, or can I expect a cash refund from them? Have I shot myself in the foot by rejecting their offer, or can I still go back to accept if need be?

Any help would be greatly appreciated.

    Thanks.

I would be most grateful for any information on the best way of reclaiming PPI .
It seems they are getting away with diddling us out of money we really did not need to pay out for in the first place, we have never claimed on any of ours so it really feels like we have been had- we really would appreciate any advice. We feel that the letters we recieve say tough your problem not ours.

    AAAAARRRRRRRRRGGGGGGHHHHHH!!!!!!

Not logged on for a day and find all these new First Plus posts. This thing is really doing my head in. In one way, i'm glad that i'm not alone in the way they are treating me, but in another i'm mad that they can cause so much stress to so many people's lives. Reading through these recent posts has made me decide to fight all the way for exactly what I want from them and I wont take any sort of peice offering. If they dont agree to refund me all of the ppi premium, then I'll fight them as far as I can!!!!
I am due a letter from them in the morning. This will be their "final response" to my complaint. I wonder what it will say?

    I'll keep you all posted.

    Cliff.

I feel the same they try and bully you I recieved another letter today supposedly breaking the 78% down
The total cost of ppi 7,983.74 the rebate offerred is not to cover the whole of the PPI just the remaining term the 6,227.31 is split rota to give you a 78% rebate of the 37 months remaining out of 60 in total!!!leaving me with 3,840.17p taking in to account I HAVE HAD THE BENEFIT OF COVER FOR 23 MONTHS ( even though i didnt bloody well need it ) a rebate of 1,133.15 was to be made when policy cancelled leaving me with 2,707.02
funnily enough the 22% retained to cover the provision of claims and administration costs was not broken down mmm wonder why
with regard the disc sent to me they have not answered any of my questions
What they didnt say is as they did on the phone this offer was a gesture of good will and is only offerred if the WHOLE complaint is dropped
however this letter actually states the offer is the rebate of ppi nothing whatsoever to do with the misselling
I dont care now will fight them all the way they seem to do exactly what they want .........................bring it on!!!!!!!!! icon8.gif

first of all the critisism from the FSA are on failures in Good Practice - go back to them and thank them for their letter as it basically admits to failures in good practice and will be used as evidence in your county court case. Regarding the requirement for 3 years that's absolute rubbish as they have to keep records for Corporation Tax & VAT Purposes going back 6 years plus the current tax year are they therefore, admitting to failure to maintain records in accordance with HMRC (Her Majasties Revenue & Customs) rules
tiggrae...used the above in my 3rd letter, and got this response on Sat am.......

We note that you have expressed your further dissatisfaction at our final response.
It is your belief that we should keep all written records for 6 years for Corporation , Tax and VAT purposes, we do NOT in fact have to keep actual credit agreements for this purpose.
At the time your loan completed it was our company policy to keep documentation for 3 years.
This is supported by FSA guidelines introduced on 15th January 2005.
The lender is required to keep documentation for 6 years after the agreement with the customer ends.
The points raised in myprevious correspondence still stand and Freedom Finance are of the belief that the policy was sold in good faith and therefore reiterate that we are unable to uphold your complaint.....
    Yours sincerely
    Compliance Officer.
Please ....what 's next step??? tiggrae?

I have received a letter from HSBC saying that they may pass my "complaint to an external consultant to assess and respond". does that mean they will send it to sols who will try and find a way to wriggle out of it lol.

They must be really stupid as i have taken them to court twice already once for charges and once for non payment of my standard mortgage protection policy. so they should know that i will not give up on this. Also since my pension with my employer has free cover of £55,000 if i die whilst in service then critical illness cover was completely un-necassary as my mortgage was only 35-45,000.

    Hi all
advice needed ,sent first letter to firstplus, got normal bog off reply,
    sent second letter ,
recieved offer of £1030 to be paid off my loan if i cancel ppi., also recieved a cd containing original conversation re:loan.
After listening to it it appears they were correct in saying i agreed to ppi,However,
they just slipped in that the loan included ppi, even after i had informed them that i get upto 6 months on full payif sick.
they do not say how much the ppi costs just that it will be added to the loan amount and they do not mention that i would still be paying for it long after the 5 year cashback offer .
any help or advice would be welcome
I'm questioning the exact thing about no mention of the PPI loan remaing and you having to pay for it after 5 years or cancelling.Ohhhhhhhhhh we love FIRST PLUS don't we !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    Can Anyone Help?
I'm In The Process Of Sorting Out My Partners Debts

He's Had The Same Credit Card With Lloyds Tsb For At Least 4 Years (possibly6 Yrs+) I Have Statements (incomplete Set) Going Back To March 04 And There Is An Amount Debited For "cardholder Protection Plan" Is This The Same As PPI?

Also He Has Always Been Self Employed We Have No Record Of The Terms And Conditions At The Start Of His Borrowing And He Does Not Remember How He Was Sold The Card. Do We Ask The Bank For The Original Terms And Conditions?
Think that is the same just trying to make it sound better. Chances are he wouldnt be covered as self employed even if it says so, seems like the only way of claiming unemployment is involuntary insolvency on my 2 policies which is rubbish. Probably worth sending the first letter and writing for a copy of the t & c from when he took it out.
