    If you'd been driving along perfectly responsibly in a 30mph limit, and someone had come the other way at 40 mph and ploughed straight in you, you'd want the police to investigate.

    And if that investigation showed the other driver had been driving carelessly or dangerously, you'd probably want them prosecuted.

    If you can't afford a solicitor, there is always a duty solicitor they can call, which I believe is free of charge.

    I realise that this must feel rather daunting at the moment, but look on the positive side. At least you didn't kill someone - there could easily have been a cyclist or other vulnerable person coming the other way.

    The maximum penalties for careless driving are: £2,500; and mandatory 3 to 9 penalty points; and discretionary disqualification.

    You are not obliged to go to the police station, unless you are arrested. If I were you, I would ask police to interview you at home. I would make a short statement "I lost control due to wet roads" and present my documents. I would decline to answer any other questions.


    If police have sufficient evidence you will be prosecuted. Nothing you say will change that, but something you do say may incriminate you.

    Yes just blame everyone else but yourself for your costly mistake. It seems to be the way things are nowadays.

    I am sure the other driver is "all well"; after all you have just written off his motor because of your driving and he will have the hassle of getting a replacement car and loaded insurance premiums for the next 5 years or so. I bet he is chuffed to bits! (/sarc off)


    Apologies if this is coming across as being a bit mean but I have had 2 cars written off by other drivers stupidity in the last three years). Bit of advice, if you are in the wrong (and by your previous post it appears that you are) man up and take responsibility for your actions. After all put yourself in the position of the driver you hit, how would YOU feel in this situation?

    If you have nothing nice to say don't say anything.

  • It sounds like there is already sufficient evidence to prosecute for careless...after all, the crash is prima facie proof of that.

    If you put your side across you may just come away with an offer of a course as an alternative to prosecution. If you go 'no comment' I think you'll end up summonsed (well that's what I'd do anyway).
