    Hi,

Had an accident a few years back, I'd skidded after braking before corner, resulted in a 3 car smash, got cautioned at the scene; then heard nothing for 5 months and 2 weeks; then an invitation to come to court to defend my case or to plead guilty by letter. 5 points £400 fine.

So would take the points instead of going to court.

I have been driving for 11 years with a clean licence I am a family man with a child with Disabilities I am not the kind person who drives like a maniac but seriously my car skid. Some people have been saying to me that it sounds like a serious case because the Police recorded my interview and now I have received the cassette tape and I need to see a solicitor ASAP but some say leave it and see what happens. I am scared that I don't want to loose my license and be banned. Thank you

Don't the police record all interviews if they're under caution?
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

Can i ask if the police recorded your statement on tape and then posted it out to you.

Hi had a car accident last week had recorded interview at police station. And today received the tape through post what does this mean.

    Notice Enclosing Tapes

One of the intentions of tape recordings of tape recording of interviews is that any dispute arising out of the interview or of the evidence obtained thereby may be resolved by the defence and prosecution before the case comes to trial.

Therefore after listening to these tapes you should communicate with the Crown Prosecutor as soon as possible to indicate wheather you are prepared to accept the Police Officers written record of the interview as being accurate for the purpose of the proceedings or wheather you wish alterations or additions to be made to the record to enable the latter to be agreed in advance of any trial.

Similarly if you wish to take issue on any matter relating to the tape recorded interview you should communicate that fact to the Crown Prosecutor as soon as possible so that whatever steps may be appropriate can be taken in advance of any trial. At least seven days notice is required to make a master tape available for court.

In respect of all the foregoing matters prompt communication with the Crown Prosecutor is essential as otherwise unnecessary adjournments may be considered.

This is what the A5 size photocopied letter received says and towards the end of the letter it gives the prosecutors address which is in Leicester. What does all of this mean or what do i have to do?

What they are asking you is do you agree that the summary of the interview is fair and accurate.

It should include all admissions and denials and the questions leading up to them.

What did you say in the interview?
Did you confirm your initial account of speeding was correct?

IIRC, the OP won't be entitled to free legal representation at home (at least not anything other than on the end of a phone). It therefore seems prudent for the OP to visit the police station at the agreed time and meet with the advocate beforehand.
He may well have been, free legal advice is no longer limited to a police station.

The alternative is to politely decline the interview and see what happens. Arrest is very unlikely given the circumstances described... it'll just end up in summons (I can't see how it would be proportionate or necessary to arrest). The exception to that is perhaps where they have suspicion of dangerous driving, but that's not how the OP's gambit reads to me.I guess you don't know you can arrest if someone refuses to attend to be interviewed?

I'm not sure where you get your information from, you're nearly well read but not quite up to date.

During the interview the officers asked me.

    Where I was coming from
Do i have a driving License
Am i the registered keeper of the vehicle
Did my vehicle have any defects
Was this the first time I was on the road the accident happened
    Was it dark
    What were the weather conditions
    How my vehicle skid
    What was my speed

    Your response to this then?

You skidded and crashed, so without a mechanical defect you caused this. Why in your opinion wasn't your driving careless?

And you said what in answer to the questions? Jeez, you ask for advice then drip feed answers to the questions you're asked. Surprisingly people are still trying to help. Why not help them out too?
