Regardless the OP NEVER paid Amazon they paid poke.io, so that is who they have a contract with.
so what you are saying is if i purchase a Russell Hobb Kettle from Argos i can get a refund from Russell Hobb as Argos paid Russell Hobb for the Kettle
You are wrong. If Joe Bloggs Ltd sold me a kosher M&S voucher and I went into M&S to spend it, and they confiscated it and said, no goods, take a hike.
I'd have a contract with M&S and Joe Bloggs Ltd would have nothing to do with it and it would be M&S I had to take to court to get redress.0 -

but he has NEVER spent it with Amazon he added a voucher code to his fraudulent amazon account and then Amazon closed his account. he made the purchase at pock.io so it is pock that has his money as thats who he paid. like you issue if you purchased from Joe Bloggs then they are the ones with your money
Like any retailer it is the retailer who has your money not the manufacturer, so consumer rights is with the retailer, regardless if it was a voucher or not.0 -

No because all M&S have done is took the voucher off you they don't have your money as its not activated, so you would have to contact the seller Joe Bloggs Ltd as they have your money0 -
maybe the OP should locate the printing company who printed the Gift card and claim the money from them0

There's plenty of theories on this thread, which is astounding considering there aren't, yet, any facts..0 -
It would also depend on why M&S took the voucher. If it was a forgery or showed up as stolen then you couldn't very well pursue M&S for the money.

That's why each year High Street Vouchers change their vouchers designs and colours and hologram to reduce forgeries0 -

We don't actually know whether they have the money or not, and you don't have the facts to make that statement.
However, my statement is correct, IF Amazon have confiscated the money without any fraudulent activity, then they have misappropriated the funds and certainly are in contract and certainly are liable for court action.
What bit do you not get, that you cannot steal something and say nothing to do with me guvnor, he bought it from somebody else?0 -

To the person tendering the voucher it most definitely has a value, and for M&S to confiscate it may not be theft in the strict legal sense, but it is certainly pretty close to it.0 -
IF Amazon have confiscated the money without any fraudulent activity,
but he open an account while under age, so it was opened fraudulently, which the OP admits he was wrong in opening the Amazon account, but the FACTS are the OP NEVER gave Amazon any money, He gave pock.io his money and then pock.io had given/will give Amazon the money for the GC, so all Amazon can do is give money back to Pock.io, so the OP needs to contact and work with pock.io to find out where his funds are0
