RTC whilst on driving lesson

  • Legally you have no right to them. Time for your son to man up, he's old enough to drive so needs to deal with the consequences.

I thought in an RTC you legally do have the right to the other drivers details? Maybe i am wonrg then?

Also, as my son is a learner and still 17 and classed as a child, the solicitors will not deal with him on his own, not until he is 18 anyway.

I am not sure if you understand my writing?
Both myself and my son have requested the information, so have the solicitors from both the driving school and the driving instructor.

What i am trying to fathom out is- is there another way of obtaining the other drivers details ?

I dont know how long ago it was since you had driving lessons but i know most young people who i have contact with wouldnt have a clue what to do if they were involved in an accident on one of their first driving lessons?!! Maybe this is something the instructors ot myself as a parent should have covered before he ventured out onto the road, but hindsight is a wonderful thing!

Put the driving instructors reg number into the MIB database and contact his insurance company.

Thank you - what is the MIB database and how much does it cost to do that?

As I said put the instructors in and get your son to go through them.

    Thank you for the replies.

Firstly, as his mum and my son only just having started driving lessons then yes i would have expected the instructor to inform me of the accident. Imagine if he had collapsed later on that night and i knew nothing about it? if he has an accident at school they would tell me so i expect the same from his driving school.
Maybe this is not the 'norm'? but we are both new to the whole experience!

What i was meaning is it seems far more reasonable for your son to tell you about the accident he was in, than have his instructor come to the house to tell you himself.

The solicitors cannot chase the other driver until they receive their details from the driving school.

Did your son not obtain any details at all then, not even the registration number?

Another angle would be to contact any associations that either the instructor or driving school are members of. They may offer advice or even help by contacting the driving school/instructor.

Yes my son did tell me about the accident but to be honest he was so shook up about it that he said it was all a bit of a blur. I know as an adult with many years driving experience that an accident can shake me up so can only imagine how he felt at that time.

No he didnt. He said the instrutor told him to get and and sit in the passenger seat whilst he went and dealt with the other driver. He wouldnt have known at that time that he needed to get those details too. Guess he put his trust in his instructor to handle it all legitimately.
Lessons learned for all of us though, when my next child comes of age to have lessons, i will make sure they are aware of this.

Would it be worth reporting the accident (and the driving school's lack of co-operation) to the police in the hope that they can provide you with the details of the relevant insurance company...?
