RTC whilst on driving lesson
After some advice please.....
My 17yr old son was on a driving lesson in October 2014 and his car was hit from behind by another car and my son suffered whiplash.
He was bought home by the instructor (who didnt even come to the door to inform me of the accident). My son said the driving instructors car was also damaged and had to go to be repaired.
Anyhow-- we put in a claim for compensation as my son suffered an injury. BUT- the solicitors have recieved no response from the driving school and when i have rung the school myself i have been told it is being dealt with. The person who answers told me their solicitors are dealing with it but refuses to tell me the name of the solicitors. They are not cooperating and the instructor himself also refuses to answer my calls or texts requesting the other drivers insurance details.
So my question is- what now? Do we just forget about it because without the other drivers insurance/car details , our solicitors cannot do anything - or is there another avenue we can pursue to get this information?

Have your sons solicitors actually pushed for the details?
Your son should have the VRM of the other car so get the details off mib.
Get your son to call and ask, after all it's nothing to do with you.0 -

I'm a bit confused by this. Why would he come to tell you about it?Anyhow-- we put in a claim for compensation as my son suffered an injury. Not sure why your solicitors are chasing the driving school.
They weren't liable for the accident. They need to chase and claim from the person liable. That's the one who hit the car in the rear
As your son was injured during the accident, he should have asked for the following from the person who caused the accident.
Insurance details
Name
Address
The solicitors should be able to get these details them self, without you or anyone else chasing the driving school companyAll your base are belong to us.0 -

As the other poster has said, let your son deal with it or more do the chasing, how is he ever going to feel like an adult if mummy keeps sticking her nose in? It is annoying and my Mum is in her 80s and still try's it , your son's claim is against the driver of the vehicle that collided with the car that he was in, part of the completion for the driving school is on the form, the question is asked "were there any other passengers in the car?" I'm sure the instructor will answer yes and they process can continue from there, beyond that it's none of your business really and the school or solicitors are not answerable to you.0 -
Thank you for the replies.
Firstly, as his mum and my son only just having started driving lessons then yes i would have expected the instructor to inform me of the accident. Imagine if he had collapsed later on that night and i knew nothing about it? if he has an accident at school they would tell me so i expect the same from his driving school.
Maybe this is not the 'norm'? but we are both new to the whole experience!
My son was not given any details of the other car and to be honest he didnt know the process either. he does know that his instructor got out the vehicle and spoke with the other driver but that is all he knows.
The solicitors are chasing the driving school for the details of the other driver, that is the problem- the driving school are not handing over those details. They have had numerous phone calls and letters requesting the information but are not cooperating and i dont know why.0 -

The solicitors cannot chase the other driver until they receive their details from the driving school.0 -

We dont have any forms or information like you quote from the driving school.
As for sticking my nose in then yes, my son is just 17 and lives at home so it is part of my responsibilty. Maybe he isnt like some 17yr old you know, but they are all different and have variable needs.0 -

Have you tried asking his driving instructor for the reg number of the other vehicle?0

I am not sure if you understand my writing?
Both myself and my son have requested the information, so have the solicitors from both the driving school and the driving instructor.
What i am trying to fathom out is- is there another way of obtaining the other drivers details ?
I dont know how long ago it was since you had driving lessons but i know most young people who i have contact with wouldnt have a clue what to do if they were involved in an accident on one of their first driving lessons?!! Maybe this is something the instructors ot myself as a parent should have covered before he ventured out onto the road, but hindsight is a wonderful thing!0
