    Section 21?

    Im off to citizens advice today anyway, see what the deal is and what rights i have officially. He try's to do anything like that and he will be going to court. What i did was for everyones saftey and everyone in the house has said they will back me up if it ever goes to court.

    He cant kick me out because he could have killed us, the courts wont see it the way he does, im sure of it.

    He can't kick you out until the end of you tenancy agreement, but my guess is as soon as that happens he will. A section 21 eviction notice is simply notification that at the end on the tenancy agreement you have to move out. If you're on a periodic tenancy then you have to move out at after two months.


    Make sure you keep notes of any problems you have with the landlord, you may (almost certainly) will have difficulty getting your deposit back (is it protected by one of the schemes?) Did you have an inventory done when you moved in?

    Nothing was done. The day before we moved in he met us outside the house he had no keys to get in, so we handed over our money and that was that, we got the keys the same day.

    Took us 3 months to get our contract sorted.

    Im not fussed what he says, the deposit will come out of the rent, he hasnt been legal about our tenancy and has probably breeched his contract several times over, so i will tell him, take the rent from the deposit. A few of the tenants did it that way, one tenant lost £400 because he wouldnt pay them

    As above, i would expect to be evicted when your contract is up.

    Ok, well it gets better than just using the deposit in lieu of rent, you can get three times the deposit back from him (& he can't issue you with an S21).:money:

    Hats off to you, JJ.

    If a few other people followed your lead and took such decisive action, then student rental properties would be a lot safer for all students.

    Oh, and I would agree with ensuring that your deposit cash is safe by taking it out of the rent. Given what your landlord has been up to, I don't see how he could expect anything else.

    The state this house is in i can see it being repossessed in the future, and if it does, i would be tempted to purchase, although its very close to birmingham uni, so id expect the prices to be naturally high anyway, most the houses round here are rented to students, although the road we are on is quite and not many students on it.

    Im going to start up a website very soon that gives advice to students about renting and advice to landlords renting to students, i think everyone should feel safe in there houses, and the past 3 months have been stressful, there have been loads of problems not just this one. I mean he repaired a leak in the shower by putting sylicon ontop of old sylicon, it come off and its leaking again.

    I just hope he knows now that throughout the next 10 months he is not going to be able to do anything dodgey while im living here.

    I'm actually planning the website right now, im a web developer anyhow, so it wont take long, i just need to get someone in with legal knowledge to write the articles, alot of it will be quoted from goverment sites, and personal stories. Im going to dedicate my spare time into helping students get legal aid in cases just like mine and worse/not so worse cases, all for free, because people should know there rights. Of course the site will not be aimed just at students, but mainly the younger generation that dont know the score.

    Thanks for all the help, i will keep everyone informed. Cant wait to have gas back on and take a hot shower and eat anything but beans on toast.
