Bank Charges Test Case Article discussion

  • Why does it seem that all Bank Charges cases are on hold when the FSA website states that ONLY cases that cover unauthorised overdraft charges should be put on hold? The actual text (copied from web states)
    "
The waiver applies only to complaints about unauthorised overdraft charges. Firms must continue to deal with complaints about other financial matters, such as insurance, mortgages or other complaints regarding their current accounts, in the usual way.
    "
If I am only claiming for charges made against returned direct debits etc should this not be exempt from the waiver and therfore progress as usual?
  • When you claim, does the bank automatically close your account?e I have an overdraft which I am currently relying on as I have lost my job due to ill health retirement, and am now living on benefits. My overdraft is currently keeping me afloat, but wont for much longer
  • Just wanted to make a point about the bank do you think that the court will go in favour of the consumer at this time as we are in recession no I don’t think so and if they do rule against the banks and say the charges are unfair who do you think will pay them not the banks but the tax payer people like me and you with the bail out money that they have received from the government and also to the point I have just had a letter from alliance and Leicester this morning that they have charged me £110 in charges for December payment review fee £25 twice then at the bottom of my statement it says exceeding overdraft limit fee 8 days at £5.00 =£40 then 1day at £5.00 so you see the banks still have not learnt they still ripping the customer off its not the government that is running the country but big corporations and the banking system on TV the other day a Russian business man borrowed two hundred and ten billion pounds from a certain bank he could not pay it so they wrote it off . now the thing is how can they do that and the average man may o £3000 but the bank will make sure and go out their way to retrieve that money from you they will take you to court and would win now that makes me so bloody mad all this started from rich bankers getting greedy and they still doing it now look at northern rock owned by the goverment but still paying .
Nine million to manager and director this government has no back bone
  • When I started my claim, Abbey paid £1300 in to my account but did not close it down. My claim was for £8000 so I proceeded with a court claim for the rest of the money and they still have not closed my account although my court claim has been 'stayed'.

I had opened an account with NatWest just in case Abbey closed my account and as of this month will have my wages paid into the Natwest. This will leave me with a £1500 overdraft with Abbey. I would be happy to withdraw my claim if Abbey cleared my overdraft. Please could someone advise if I can suggest this to them. Is it a legal request or am I on wobbly ground? I would be happy to lose the remainder of my claim to clear my overdraft and put this to bed.

  • Hi, I have had an HSBC current account for approx 20 years and recently opened a business account with them, this month I accidently went over my overdraft. This happened in 4 transactions therefore they are trying to charg me 25.00 for each totalling £100.00 for going over my overdraft on my current account, once I realised this I rectified my mistake and put some money in to cover it but they said they are still charging this, does anyone know what my rights are here or if I have to pay them.

    Thanks:confused:
  • I changed Banks approximately 18 months ago - can I claim charges back from my old Bank?
  • hiya.
HSBC are now calling their bank charges an 'informal overdraft arrangement fee'. They charge this evey time you go over your official overdraft limit. I would say that technically it is a bank charge, however as they have worded it differently, am i still able to claim????
  • Whilst the court case i have against my bank is on hold, and has been for ages, is my claim still attracting interest at 8%. If it is can this be considered as an own goal against the banks !!!!!;)

Barclays do the same thing, but have called it a "reserve fee" for the first £1000 that you go over your authorised overdraft limit. I've been stung twice in the past couple of months for this "service", so I too would like some clarification on this issue.
  • I am a taxpayer who is among millions bailing out the banks in their hour of need, in this recession and credit crunch, and I am suffering financial difficulty having being threatened with insolvency and repossession in the last 6 months. It is making me so angry that the Halifax have refused to help me out by giving me back unfair current account charges of over £4000, and have never even responded regarding my attempts to retrieve credit card charges. And yet the big bosses getting their bonuses!!! Is the big bank bail out affecting other peoples attempts to get charges back? What can we do? I for one am going to the papers!
