Martin writes this under the question about reclaiming if you are having current financial difficulties
Although there is no firm definition of what genuine hardship is, it generally applies if you are not able to deal with your debts, for example you have mortgage arrears and lots of credit card debt that you cannot afford to pay back.
Does having a DMP with CCCS fit the criteria ... ??0 -
is there any template that can be used to send to courts, bank in regards to the cases being suspended and causing financial hardship?0
-
my bank made me an offer which I turned down, can I still accept it or will the bank hold off on payment due to the test case0
-
We were getting DSS benefits when all our bank charges were applied. We have a payment arrangement with payplan now & are no longer claiming benefits as I am now working full time. Can we still claim back these charges despite the latest developement? We live in Scotland - how does this differ by law?0
-
What about those cases where the banks paid about 90% as the court date arrived and then the judge allowed a period of time for them to defend against payment of the balance?:rotfl: Older and growing0
-
Assuming the test case takes a considerable time to determine, the banks have between now and the determination time, ample opportunity to apply further charges to accounts. Is there any way customers affected during this period could argue that they do not intend to repay any charges applied until the determination of the test case they are using to avoid repaying newly charges until the case is determined? (Convoluted - but I'm sure you get my drift)0
-
you have had this issue taken away from you and the ability of individuals to pursue their claims has been closed down, how long will it take the banks to recover their £500 million.
you need to apply your fighting fund to having the OFT decision reversed,
my prediction is you have been stitched up like a kipper,0 -
My bank made me an offer in early July that I rejected by making a counter offer to them, since then the OFT has announced their case and I am regretting that decision. Can I change my mind, or will my bank put the case on ice or simply reject it now?0
-
Could you help out regarding the information needed to put forward this case?:beer:0
-
What will happen to the people who had just (ie two day before the test case rule thingy!!!) paid to take their bank to court?!!0
