The Small Claims Court entered a judgment against Halifax 16th July. They have delayed paying me back since then (nearly a month).
Customer Services advised me to visit the branch to have the money paid back to me. I made an appointment with the manager and had the court papers faxed to Customer Services. They say it will take 1 to 2 weeks to get a decision.
Whikle I was withy the manager he asked the advice of his area manager who was visiting. He reported the area manager as saying that all court action has been stayed INCLUDING bailiffs recovery.
I BELIEVE THIS TO BE UNTRUE and will test it by instructing the bailiffs today.0 -

Just goes to prove what bank managers know. No you can't "stay" bailiffs recovery although they could apply to set judgment aside but that's nor automatic.0 -
1- i have several accounts with one bank. do i need to fill in a separate template letter for each one, and will they require £10 for statements for each account?
2- does this work for business accounts also?

There has been no correspondance with regards to this so far.
In hardship cases can you insist the bank pay you by personal cheque instead of it going back into a closed account (where I am paying off £1.00 a month).
CAB and online debt management have no clear advice on this.0 -

you only need to send in one cheque per bank (not per account) as you will be requesting under the dpa the information they hold on you which covers all your accounts with that bank. just make sure you list all the account numbers in the letter.0 -

Q: Only eight banks/building societies are in the test case, can I reclaim from the others?
A: Banks have to agree to the FSA waiver in, to be let off dealing with reclaim cases. So far we’ve only been informed that the banks who are going to court have signed the waiver; yet it is very likely that all banks and building societies that offer current accounts will sign up. If any don’t, of course the details will go in the weekly e-mail.

2. Banking is not an exact science, debits made in shops or stores can be held for up to 6 months and then processed. Can you keep tabs on transactions for 6 months? Do you want to have to track them for 6 months?
3. I am not an accountant, I use banks because I have no choice and try my best to utilise their systems to make life as easy as possible for myself. I do not want to nor do I feel I should have to keep an almost total vigilant eye on the ins and outs of my account.
4. The cost of bank charges does not represent the true cost to the banks when one goes into an un-authorised overdraft or when a debit is taken months after one shopped and only went 7p into the “red”.

Ok, so I moved from The Abbey to The Cooperative thinking it was a more ethical bank, and in many ways it is. However, their bank charges are actually higher per item than The Abbey's! (silly me!) I have written to The Cooperative Bank suggesting that alongside their campaigns to save the world, eradicate poverty, famine, clean up villages' water supplies and not support oppressive regimes that they might consider being nice to their customers and not charge hideous bank charges that cause so many people to fall headlong into a spiral of debt. I am still waiting for a reply! (6 months have now passed? Anyone up for challenging them on this? Does anyone know of a reasonable bank anywhere in this alleged free and democratic land we survive in?

What action should you take if you think your Bank might have delayed dealing with your complaint until after the waiver was issued?
I ask this as my final letter demanding my bank charges after following your websites advice, was sent to my bank on 16th July 2007. They responded saying my complaint was now on hold but I'm suspicious that they may have negated to deal with it pending the FSA's announcement. I also e-mailed my bank asking if they would confirm when they applied for the waiver and when it was granted but they told me they were "not obliged to give me this information".
There is a letter on the FSA website to the CEO's of major banks stating they had evidence banks had been delaying dealing with complaints in general. More salt is rubbed into my wounds as a work colleague applied for his charges at the same time as me and he received a very good offer and I'm left kicking my heels.
