    take the offer and when the cash is in your account,claim for the new charges that you have accrued.

    Although tongue in cheek you really need to do this. I'm after 4 grand from Barclays with nothing being offered. Take it and then wait and see what happens with the test case. You've been very lucky. Many people would love to be in your position.
  • I am with Barclays and I had a bank charges claim that was put on hold - I phoned them and just asked what I needed to do to ask them to look at the claim under the financial hardship rules and they sent me a budget planner which I filled in and sent back. They agreed that I was in financial hardship and asked me when from so I said it had been about 18 months since I was made redundant and they refunded half of my bank charges for the last 18 months. They will still look at my claim again if the test case says that we can get a refund but they will just take off the money they have already paid me from any payout that is due to me so my advice is give it a go. It was a very long process though - they have got lots of people trying to do the same thing and I think it took about 4 months in total for the claim to go through.

    HBOS to change most bank accounts


    Millions of customers with the Halifax and Bank of Scotland will see big changes to their current accounts in the New Year.

    The standard set of overdraft fees, including interest charges, will be replaced by daily fees of £1, £2 or £5 when people are in the red.

    The charges will start with the launch of a new account on 9 February 2009. But most existing accounts will be moved to the new charging structure later in the year.

    The new accounts will abolish the current interest charges for people in the red.
    Also disappearing will be the existing overdraft fee of £28 per month, and the maximum three charges a day of £35 each for bouncing cheques or other payments while in the red without permission.

    Instead, customers with an arranged overdraft of up to £2,500 will pay £1 per day; those with a higher arranged overdraft will be charged £2 per day; and anyone with an unarranged overdraft will have to pay £5 per day.

  • Interesting stuff. Particularly interesting to hear the preparatory steps Natwest are taking as I've passed the 3rd letter stage with them and I'm in two minds as to whether to submit a court application here in Scotland (where some courts are not permitting stays and are hearing the cases regardless of the OFT case), or register a complaint with the FOS pending an outcome of the OFT case. Now, I suppose I'll have to add a 3rd to those choices which is effectively 'sit and wait'.
    Almost debt-free, but certainly even with the Banks!
  • I mistakenly went over my overdraft last month. I received a letter from my bank stating that they have charged me a 'payment review fee' of £25.

    I'm out of touch with ll the latest rulings concerning this. Do I have the right to claim it back or some of it?
  • :eek: I started my claim for my bank charges a while ago just before everything got put on hold, and received a standard letter from the bank telling me they felt the charges were justified.
    What should I be doing now? Any help appreciated.

    Continue to the next step & write a letter before action. If they still won't play ball, start a court claim. It will be put on hold like all the others but the court will still accept it. Regardless of the test case, people should still follow the steps, stick to the timetable and take action NOW. Forget what the bank tells you about the test case, since when was their information trustworthy? They're hardly likely to tell you that its in your best interests to continue, but it definitely is..
