I have been following this campaign for a while now. I am an Irish national and have written to my ombudsman requesting information as to the legality of reclaiming similar charges here in the ROI. I have yet to hear anything back however I have written to my bank/credit card company requesting a list of the charges I have paid so I am prepared. I was just wondering if anyone here knows of a precedent / legislation in the ROI similar to the Unfair Terms in Consumer Contracts Regulations in the UK?

Surely they are not still sticking to this line of defence, we all know the charges they currently employ are way way over the top! Its ridiculous they can put all complaints on hold almost indefinately and still get away with charging us over the odds every single day of the year!Q: How can you continue to charge what you do for these services when there is legal challenge?

They're preparing for failure:
Bank Plans Overdraft RefundsThe RBS NatWest bank is planning to refund overdraft fees to customers "pro-actively" if it loses the continuing test case over bank charges.
An internal bank document reveals for the first time the preparations banks are making should they lose their case.
The leaked document acknowledges the group may have to refund past charges, which could run to many millions of pounds.
The RBS NatWest is waiting, with seven other banks, for an Appeal Court judgement on whether or not the Office of Fair Trading (OFT) can decide if their overdraft charges are unfair.poppy100 -
had lots of financial problems recently. had a loan for £14000 with natwest which i couldnt pay. it ended up going through shoosmiths which now have a charging order on my home. (refused any negotiation of payment but have finally backed off for the moment as i have a disabled son) . in th emeantime i worked out that over the years Natwest would owe me almost £8000 in refunded charges and interest. although i am on my feet financially now and managing to pay off my debts would the charging order be a suitable reason for the court proceeding with the case for a refund. i am also a very worried that if i go ahead with it they will enforce the charging order Any help please:eek:0

I'm getting fed up with the whole affair now. Why can't these people get it sorted one way or the other?
If I do something wrong I would expect to be punished absolutely no problem with that.
Why should people who are good with money bail out people who aren't? They shouldn't.
I'd like them to treat each case individually because I think everyones is unique in the way they have amassed these charges.
I would be happy to stand in front of a judge and ask his opinion as to why a bank should charge someone 1.2k in one month because the plonker had got in trouble.0 -

In September I sent my hardship application to Halifax, a few days ago this month I got a reply. I was claiming £1,693.61 however they offer me £1,609.50. The thing is that since I made my claim in September I incur in some more charges in October and November. So my question is should I accept the offer or should I tell them to include the October and November charges in the final pay out. What should I do? Help please.

The thing is that since I made my claim in September I incur in some more charges in October and November. So my question is should I accept the offer or should I tell them to include the October and November charges in the final pay out. What should I do? Help please.
