  • I claimed on my charges about a year ago with the Halifax and only got 50% of my charges paid back to me.

    I've just been told that I should get back in touch with them as I'm entitled to the full amount.

    Can anyone confirm if this is true please?

  • Hi, I set up a claim against my bank 2 years ago. I followed trhe usual process, wrote to them, set out the sum claimed and awaited their response. Eventually I received a letter re the 'hold' on cases and an expalnation that he outcome of my claim would depend on the OFT case. I requested that my account be suspended as the charges claimed wholly accounted for my overdraft (as I had refiused to pay them). I heard nothing until last week when I recieved a county court claim for the amount contained in my overdraft ie the 'disputed' charges. Surely if the claims against banks are on hold can I not claim the same status to the claim I have received

    You need to apply to the courts the same way the bank has been doing for a stay on the case. There is no moratorium on bank charges while the OFT test case is pending.

  • Hello, Does anyone know if you can reclaim bank charges if they are for going over your overdraft as I bank has taken some £200 plus over the last two months which has in fact been the thing that has taken us over the overdraft. Is this legal? All advice welcome. Cheers
  • I currently live in Spain but due to move back to the UK soon. I have been charged incredible amounts with my banks here. I cannot seem to find any information on whether the claims system just applies to the UK or it applies to Europe as a whole. Can someone please advise me as i could be missing out on thousands of euros.

    You need to look into contract law in Spain and Banking law in Spain to see whether the bank account complies with them.

    As it stands today, it is LEGAL but is subject to the OFT Test Case. If the charges are for going over an agreed facility then yes they are claimable.

  • i applied for this hardship case as my partner has lost his job,NATWEST sent me the financial form to which i filled out and sent back.Four weeks later i had a reply to which i had to phone an 0845 telephone number in Glasgow!
    I spoke to a lady who told me that i did meet the financial hardship criteria but Natwest were not offering me anything back! I astonishingly asked why not if i met the criteria(in more than 1 way) and she said that unless there was a court action about my house being repossessed they wouldnt consider it!! However she did say that they would put me on the hardship scheme,which means no furthur charges,loss of switch cards to a solo card,lower loan payments..to which she added this will affect my credit reference! i felt utterly disgusted and embarrased,also upset;i took her name ,which she found amusing and put in a complaint with the financial ombudsman;I THOUGHT THIS POST MIGHT BE HELPFUL AS THIS PROVES EVEN THOUGH YOU MEET THE CRITERIA OF HARDSHIP THEY CAN STILL REFUSE TO PAY UP!! THEY ARE MOVING THE GOAL POSTS!!!!!

    Hi,

    I'm recently bankrupt (have been told by O.R should be discharged within the next 8 months). Does the fact that I am Bankrupt and the accounts I will be claiming on are subject to the BR prevent me from making a claim once I'm discharged. I have seen that people on IVA's have done so and I'm hoping I can too?

  • what is happening with the bank charges test case as its all gone very quiet. I submitted all my info about 18 months ago and apart from a letter I received from Alliance and Leicester a while ago saying about the test case etc, its all gone very quiet .. will the credit crunch also have an affect ?

    Hello,
    I launched a claim against Barclays last year and got as far as issuing Court proceedings through the online moneyclaim system just prior to the test case. My case had a stay put on it as a result. I have heard nothing since then from the courts. Does anyone know if the case will automatically continue once the stay is lifted, or if I will need to progress this manually again. From what I can remember my claim was for about £3,500 and I have already paid about £100 court fees to lodge the claim.
