  • Hi, could someone just put me right on something. I have given up all hope of EVER getting any fees returned, my case was put on hold (stayed), August last year, and I have heard nothing since. Even nothing from the court! I want to throw everything away...it makes me fume everytime I look at my bundle of papers. Could someone just say, is anyone else out there stuck in the same way. I assume that I am not supposed to do anything myself..i.e. contact the court!
  • I have an account with one of the large high st banks. Around november last year this bank changed its policy on charging from the standard £30 per incident up to a maximum of £90 per month, to a system where a one-off £15 pound charge is made then a daily charge is added ranging from £6-£20 depending on the amount over you have gone, untill the blance is paid. This is done up to a maximum of 10 days per month. This means you can now be charged £215 in a month if you cannot pay it back with in those 10 days. I am concerned as this change apparently to help customers happened around the time of much publicity when people were claiming back charges and there is much more talk of it being an unagreed overdraft fee rather then a penalty charge, is this a ploy by the banks to keep on taking charges which could not be claimable? It seems like this daily charge is basically intrest which to my understanding is aslo included in claims.. in your opinion could this be claimed back also?? unfortunately this has happend to me more than once so I would want to add this to my existing claim. Does anyone know if this is possible??

    I have sent a letter to the Abbey National twice now with my breakdown of charges and still have not received a reply. I have unforunately incurred more charges since my original letter, should I send a new letter with the new charges?? Please could someone help or advise me. Thank you v much

    I'm a little confused and overwhelmed with what's been happening lately, so thought it would be best to ask on here.

    I filed a claim several years ago, claiming 6 years worth of charges (up until Jan 2006). I got to the point of a court hearing, but then the bombshell of the test case was dropped upon us and, as I really couldn't wait any longer, I took the banks offer which was OK (£2,600 opposed to the £3,800 I was claiming).

    Since then, I have been stung almost every other day with charges and, as I'm unemployed, I'm struggling to make ends meet. In fact, it's these charges which are causing my financial grief. Without them, I would JUST about manage... but they're currently snowballing out of control.

    Ok, to the nitty gritty. Can I:

    a) Claim from Feb 2006 to now?
    b) As I am unemployed, what is the best way to go about this?
    c) How long would this take?

    Yes you can claim from 2006, and ask to have your case looked at due to finanial hardship, they should send you a form to fill out so you can prove you are struggling finacialy. This does not guarantee they will pay out before the end of the test case , but some cases are being paid out due to this.

    Have just recieved a letter from HBOS today saying i qualify under the financial hardship rules, and they are refunding me £1040 within 14 days. This is but £10 shy of what i asked for and includes interest!!

    2 direct debits were taken at the wrong date and another arrived at the same time from a company that Id cancelled my contract with a year previously. Id not ever needed an overdraft so hadnt arranged for one. I had £150 in the account just in case - 3 days before payday. I would have been £13.99 overdrawn which I could have of course deposited in minutes right from my purse! RBS refused time/consideration calling it "increased borrowing" and "being responsible lenders" - how responsible was it to steal half my wages?

    They'd called before if I was about to (say) be 50p overdrawn the day before payday - which I fixed immediately - they didnt need to call me this time because I was on the phone to them 25th, 26th and 27th of Jan while it was all going on (I was asking about my loan PPI) but my "adviser" didnt "advise". Ultimately the loan amount was slashed by £10,000 so RBS angle that they couldnt "lend me £13.99" became an invalid reason in the end!

    Charges amounted to £350 and RBS refused to give me ANY back. TERRIBLE 2008 fighting to get these idiots to see they were wrong to submit the direct debits. 2 finally admitted fault, one "lost my record" (how convenient).

    RBS say theyve given me £100 "in good faith" I saw £50 on my statement but not £100 but even that doesnt go very far in compensating me for being without any money till February 28th - when I got paid next - NO money for food! And the stress, the tears, the feeling of being spoken to like I was some kind of thief!

    That FSA have found against me while everybody's getting their money back without any of the circumstancs Ive had is really shocking to me. Ive spent so many days crying.

    I can appeal before 6th October, which I intend to but yet again, Ive to trawl through statements and correspondence - Im just so exhausted. Even a man on RBS head office said he was being recorded saying "to fight them all the way because I should never have had to pay those charges" and that I could ask for the recoding/transcript at any time! So how cn FSA find against me!

    Its not as if Ive ever been overdrawn in the 6 years Ive been with them! This wasnt even a situation that the bank had to "slap my wrists for being a persistently naughty girl". I'm devastated - really - no-one seems to care and it looks like legally (unless I could afford a good lawyer) I havent a leg to stand on either.

    I did wave the Direct Debit Guarantee at RBS and they said they'd call the agencies concerned and "then and only then would I get my charges back" (naughty girl I am) but instead my payments which were by then actually DUE, appeared back in my account but my charges for them didnt! I was then LATE with the payments and (I'm scared to look) my credit rating has probably sunk to the lower levels of acceptability when before it should have been fine (I dont ever miss payments!).

    Direct Debit Mandate is as much use as a chocolate fireguard, RBS have shafted me majorly.

    I recovered financially because Im on a good wage but I dont think it should be allowed that companies can effectively STEAL from me! Put it this way - three strangers walked into the bank and they let them take money out of my account and charged me £350 (plus) for the privilege!

    Hi all and sorry if this is in the wrong place or already been asked
    But does anybody think that with all the takeovers and nationalisation going on will people that have cases with the banks that do not exsist in their own right anymore still be able to claim from them? and will they have to start a new case with the new owners? and will this mean that some of us are taking the government to court?

  • I've been approached by phone by a company called Wade & Co - legal advisors who say they (for £49.95) can send me the legal pack that will ensure I get my moneyu back with the banks.
    When I said I already have a claim with my bank, in waiting, they said that this is the reason that I'm not getting the money - because the letter I sent (Martin Lewis's letter) isn'6t a legal document and the banks can hold out.

    Can anyone advise what i sohuld do - I'm claiming for £1200 so would be happy to pay their costs for their 'legal' letter if it's going to make things start happening.
