You've had £3000 charges on your account since June 07 ?
Depending on your circumstances you may be able to claim hardship and get some assistance off the bank to help you get straight - things like move your account to basic, stop future charges etc. Some hardship claims are getting refunds but its a bonus more than anything.
Write to the bank with an Income/Expenditure sheet and explain you want to reclaim those charges and you are in hardship and why and can they help you. Also if you are still with the same bank I would move, seriously. Whats your overdraft situation with them ?
Theres no problem in reclaiming for a second time if they have kept hammering you for charges, but you should also look at the underlying problems that are causing you getting so many.LegalBeagles0 -
I currently have over £500 of bank charges that have accrued over the last 6 months. I have tried to arrange payment with the bank but they wont accept any less than £100 a month which I cannot afford. I already have a claim in for previous bank charges of around £1,400 on the same account. They are threatening legal action and I dont know what to do exactly, can I refuse to pay on the grounds they are un-lawful and put a claim in or do I have to pay or can I go down the financial hardship route? Please get back to me as soon as possible. Thanks
Well you can amend your claim to include the newer charges, so thats no problem. Part of the waiver is they won't hassle you for overdraft repayments of the amount thats outstanding in your claim.
This £100 a month malarky - if you can't afford it don't agree to it - send them an offer of what you could afford a month backed you with an income expenditure sheet.
Hardship depends on your circumstances and doesnt necessarily mean a refund. Does mean they should give you and your circumstances a bit more consideration and may involve moving you to a basic account and stopping future charges while the matters being decided in the courts with the test case.

I have just put in a claim for tax credits, i couldnt do this before due to my partner not completing his end of year accounts. So hopefully some more money should be coming in, but still not enough. 0 -
My case is not with a county court but with municipal court is this covered under the oft's stay on claims as this seems to me to be only covering county court claims,

Am not entirely sure if I would qualify for the 'hardship' claim. Am on Income Support, Carers Allowance, Housing and CT benefit. Have been on benefits for the past 7-8 years
I put in a claim a year gone Feb which has been frozen. I changed my account to one that wont let you go overdrawn, but my claim was for over £3k including interest accruing from 6 years previous.
Since then my dad had a little windfall and bought us a little run about car. Newest car I ever had 04 Punto, with less than 11kmiles on the clock it was twoked after the theives stole the keys from my house, came back at 4am and wrote it off. I had booked a little holiday for me and the bairns at a caravan park in the lakes, but had no way of getting there. A friend kindly offered me her car (shes unable to drive at the moment through illness) but the insurance for me was £90 , which ate the holiday fund which was megre to start with so I had to borrow £50 from my dad for diesel to get us there and back. (thank goodness for the kindness of friends and family helping to restore faith in human nature) but on top of this I have had to change sims for me and daughter as we were receiving harrassment calls from the twokers families as they had lost their jobs through the court case.... and well theres been other odd bits of expenditure that we could all do without.
Would this qualify as hardship or just stupidity on my part for leaving my keys on show? would having a car stolen be even considered as in itself its an asset and not a necessary luxuary ? Would it be prudent to maybe ask for an advance of PART of my claim, or would it stuff my claim up entirely as they could call in the 'full and final settlement' card? And please dont get me started on the cost of school uniforms
any thoughts on this would be extremely gratefully received and sorry its a long post xx0 -
Hi Martin, I approached my bank tell them that I fit into the hardship rule. They said that they had never heard of this and there was nothing on their website, therefore I was unable to push my claim forward. I bank with the H.S.B.C. Is there anything I can do????????
