But does anybody think that with all the takeovers and nationalisation going on will people that have cases with the banks that do not exsist in their own right anymore still be able to claim from them?Yes claims can still be made and will they have to start a new case with the new owners?nope and will this mean that some of us are taking the government to court?Technically yes, but no as it is Northern Rock/B&B you are suing

I am in exactly the same boat, I am with Lloyds TSB, the last time I spoke to them they offered me an "agreement" where i pay £20 off my overdraft every month, which I accepted just to keep them off my back in the hope that the test case would be sorted out in a few months, but my overdraft hasn't gone down so I have just carried on using my account as normal. Everytime I write to them they just send me the same standard letter saying we can't look at your case until the test case is over blah blah blah, they acknowledge that I am in financial difficulties because they have made this "agreement" with me but they haven't sent me any sort of form to assess this or offered me any kind of refund despite having written to them several times including once threatining to take them to court and telling them about my financial hardship (I am a student)

2 direct debits were taken at the wrong date and another arrived at the same time from a company that Id cancelled my contract with a year previously. Id not ever needed an overdraft so hadnt arranged for one. I had £150 in the account just in case - 3 days before payday. I would have been £13.99 overdrawn which I could have of course deposited in minutes right from my purse! RBS refused time/consideration calling it "increased borrowing" and "being responsible lenders" - how responsible was it to steal half my wages?
They'd called before if I was about to (say) be 50p overdrawn the day before payday - which I fixed immediately - they didnt need to call me this time because I was on the phone to them 25th, 26th and 27th of Jan while it was all going on (I was asking about my loan PPI) but my "adviser" didnt "advise". Ultimately the loan amount was slashed by £10,000 so RBS angle that they couldnt "lend me £13.99" became an invalid reason in the end!
Charges amounted to £350 and RBS refused to give me ANY back. TERRIBLE 2008 fighting to get these idiots to see they were wrong to submit the direct debits. 2 finally admitted fault, one "lost my record" (how convenient).
RBS say theyve given me £100 "in good faith" I saw £50 on my statement but not £100 but even that doesnt go very far in compensating me for being without any money till February 28th - when I got paid next - NO money for food! And the stress, the tears, the feeling of being spoken to like I was some kind of thief!
That FSA have found against me while everybody's getting their money back without any of the circumstancs Ive had is really shocking to me. Ive spent so many days crying.
I can appeal before 6th October, which I intend to but yet again, Ive to trawl through statements and correspondence - Im just so exhausted. Even a man on RBS head office said he was being recorded saying "to fight them all the way because I should never have had to pay those charges" and that I could ask for the recoding/transcript at any time! So how cn FSA find against me!
Its not as if Ive ever been overdrawn in the 6 years Ive been with them! This wasnt even a situation that the bank had to "slap my wrists for being a persistently naughty girl". I'm devastated - really - no-one seems to care and it looks like legally (unless I could afford a good lawyer) I havent a leg to stand on either.
I did wave the Direct Debit Guarantee at RBS and they said they'd call the agencies concerned and "then and only then would I get my charges back" (naughty girl I am) but instead my payments which were by then actually DUE, appeared back in my account but my charges for them didnt! I was then LATE with the payments and (I'm scared to look) my credit rating has probably sunk to the lower levels of acceptability when before it should have been fine (I dont ever miss payments!).
Direct Debit Mandate is as much use as a chocolate fireguard, RBS have shafted me majorly.
I recovered financially because Im on a good wage but I dont think it should be allowed that companies can effectively STEAL from me! Put it this way - three strangers walked into the bank and they let them take money out of my account and charged me £350 (plus) for the privilege!

The direct debit guarantee scheme does not cover you when the bank return items unpaid. It is the one area of it which IMHO is no guarantee at all. The companies concerned have to refund it, as per the FOS view even where they are at fault. The problem is that this is an arduous task because if that charge causes further charges then you have to battle for months over this. I understand what you are saying and the DD Guarantee Scheme is IMHO flawed in this regard.0 -

I wrote a letter(from the template)to my bank(LloydsTSB) about 3 weeks ago along with a postal order of 10pounds and I still havn't heard anything back from them, is this normal?
What should I do to chase this up and who do I write to to chase it up?

I thought the idea of reclaiming £sssssss from banks and credit card companies for the extortionate fines they impose plus interest is so that it boost your bank account so you become solvent again?
If you get a substantial amount of money back from them the nuse it to clear your cards at least and cut them up, or keep one use it for a small purchase and then pay in full before the due date that way it will show up as a tick in the box on your credit report and increase your score.
If you are then in a position to take out a new credit card do the research choose one that doesn't charge interest on a balance transfer or transfer fee, draw a sensible amount out that you know you can meet the monthly repayment on time but put the money you transferred in a cash isa, keep an eye on the calander and draw from the isa the balance you need to repay the card in full, before the card account reverts to chargeing interest. You score rises so does interest in your isa, from money which wasn't yours in the first place. Then do exactly the same with another card company.0 -

does that tell me that i will regain all the money i lost in my account from bank charges,or is it visa verse0
