    Just thought I would let you all know I had a small claim court with Nationwide since 3rd May2007 and they had until next wednesday (08/08/07) to defend and hey presto the money of £180.00 (less £14.09 interest and £30.00 court fees) was credited to my account today.

    Seems strange they have paid out when they struck a deal with the OFT for a test case. But I dont care I got back what was mine.

    My weekends going to be good.

    It might and it might not it really depends on your judge. Is it a full hearing or a directional hearing and which bank is it?

    Ive just had a thought regarding the past few posts and Tom Brennans case.

    Do you see the banks depositing money in claimants accounts so they have no argument when it goes to court?
    I mean they could force a smaller amount in than youre claiming and you maybe wouldnt bother chasing the costs?

    hi guys im hoping someone can give some advice i was about to submit my claim online last fri but didnt as it came out that they are going to do a test case,do you think i should hang fire and see what happens,im really not sure what to do?

    hi all,

    im trying to deal with my mums claim to barclays they have sent her a letter saying they not gonna pay her bk and that she can go to the FO, obviously they know she cant do that seeing as the letter was dated the same day as the test case announcement, she cant afford to go down the court route, (shes a pensioner on a small wage) so we were trying to write a letter in answer to theirs, replying within the 8 weeks timescale they gave her, to say basically that we will await the high court decision before pursuing this claim..can we do that??? if anyones got any idea on how to phrase the letter id be very grateful

    She might come under then 'benefits/hardship' part - follow the link and goto
    'Other specific issues and questions'
    She might not have to pay the court cost. - look up info on courts and see what they say about low wage/benefits - I think there's a form to fill out. sorry I'm a bit vague but I'm working so I didn't look closely.

    Several of the banks already do this, Lloyds, Abbey, Yorkshire to name a few and call it a goodwill gesture which to a certain extent has the opposite effect on what you are saying as it can be seen as an admission that they are due the claimants money.

    Even if the banks were to lose this court case tho the same is going to happen the losses will be recouped, whether its fixed banking charges, atm charges or something else.

    Hello,

    Just wondering, as this test case is for unauthorised overdraft fees can I still reclaim for returned direct debit fees? As it stands that's all I was claiming for in the first place.

    On 15th July I received an offer from my bank in relation to me claiming back my charges. The offer was time bound and clearly stated it was an EX GRATIA offer. By signing the agreement and sending it back immediately the bank would refund it to my account immediately! Isigned and returned it immediately recorded Delivery. Guess what, this has not happened.....:mad:

    During the process of claiming back my charges the bank have been prompt in their replies etc. Since signing the offer of agreement I am unable to talk to anyone in my bank about it and have now been told it could take up to 2 months for the money to be refunded to my account? This is not what I was led to beleive when I signed the agreement.

    Has anyone else exprenced the same problem? Does anyone know what my legal rights are here? Any ideas what I should do next?:confused:

    I would truly appreciate any response to this article.
