  • Just read details on FSA website and notice they only mention Unauthorised Overdraft Charges, does this mean I can still claim back charges for non-payment of Direct Debits etc? I am in the process of claiming charges back from A & L.
  • I spent 6 months trying to get a statement of my charges from Lloyds, got fobbed off like nobody's business - obviously stalling so I ended up reporting them.

Then last week! hurrah - the statements landed on my doormat!

The next day - all this test case business kicks off and my claim back is delayed.

I could have a persecution complex... but has this happened to anyone else?
I don't think it's a co-incidence that I got my statements just before all claims were put on hold.

Just curious here, is there a reason why OFT had no problem issueing a cap on credit card fees but are handling banking fees a much longer winded way through the courts.

As I understand the argument credit card companies do not have other products so cannot seek to recoup the loss elsewhere. The OFT's concern was that if they did the same with bank charges the banks will just seek to recover teh loss in another way from customers. Also I do not believe that there is agreement as to what a fair chrage would be,
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

Marc,I don't know about the MY bank keeping me up to date with the progress of the case as I had to get the Information Comissioners involved because the bank didn't send me the list my charges within the 40 day deadline and they had to intervene to get me this info. The only good thing maybe is that I've had a complaint raised with the Financial Ombusman for about six weeks waiting on the final answer from my bank so maybe they will honour this. I'm relying on alot of maybe's eh?Well fingers crossed.Lorna

Well done for exploring your rights, the problem with these coperations is that they exploit peoples ignorance and hope we (the problem makers disapear) go away. If your a person who accepts things then you are damaging your country and the next generation of information seekers. Accept nothing until there is no more room to ask for reviews appeals or even court. People power works as you can see by fantastic sites such as this one. everyone involved in the bank charges saga deserves a huge pat on the back because the people that count are finally listening. WELL DONE EVERYONE XX:T

Of course the person would be paid out their charges as their case had obviously come to a satisfactory conclusion, this is nothing to do with "keeping good relations with CAB".

Any offers that have been accepted must be honoured by all the banks.

Please read Martin's Emergency Guide, which will be updated as and when changes occur.

Thanks for your reply although it doesn't make sense, in the particular case i was talking about it was soley to do with good relations with CAB, we have a very productive working relationship with RBS and other banks, they benefit from our service greatly (I'LL SPARE YOU THE ECONOMICS LESSON), what you will find if you contact most banks just now is that they will say something along the lines of "Oh have you not heard about the FSA/FSO statement that was released on 27th July". These forums can at times become tit for tat, i'm not here for that game, i'm here to offer professional advice and experience. I'm more than qualified to talk about these issues, I'm not just shouting my mouth off to look good for other users as the majority of people on here seem to be doing, my advice is 100% accurate and up to date, and if someone needs encouragement from people who do this for a living then i'm more than happy to empower them, after all thats the point of CAB and me. So please stop throwing toys out the pram. I haven't said anything careless or unaccurate. this site is supposed to be about peoples expereinces and to help and encourage others, that is what i'm doing so stop trying discredit everything i say because that would be foolish and wrong.

techspec is spot on by the way.
  • I went to court today and a representative from barclays turned up!
They wanted the case adjourned until after the test case - which is what happened! couldn't believe it after everyone saying that'd i'd be in and out of there in ten minutes etc.. now i have to wait until next year to ask the court to hear my case again! The judge did seem to be on my side though and he said he realised how I felt but there was just no point awarding it to me apparantly as Barclays will now appeal anyway.

If only my court date was a few days earlier!!!

While noting what you say and while you may be correct that some people may be shouting thier mouths off as you put it. I am sure that I am not the only person who gives a view which is based on personal knowledge while not being legally qualified. Do feel free to have a look at my posts and let me know if you disagree with the views expressed.

My wife just got £30 letter from LLoyds today - shouldn't banks with-hold charging people until this has been sorted out. It's a little do as I say not as I do isn't it?
