The point was that whilst suspending compliants unitl the case as you have correctly pointed out is heard at the high court, they should also suspend collecting these very disputed charges as it would only be fair.
lorna anne today one of my clients was awarded £3542.89 in charges from RBS, so although they can waive, in order to keep good relations with CAB, they seem to still be paying out for now, although i have been informed this will stop soon.

Its all about consumer people power, the banks have been told that they must keep its custoemrs up to date with the progress of the case, so they will not ignore you any way, lorna0

Marc,I don't know about the MY bank keeping me up to date with the progress of the case as I had to get the Information Comissioners involved because the bank didn't send me the list my charges within the 40 day deadline and they had to intervene to get me this info. The only good thing maybe is that I've had a complaint raised with the Financial Ombusman for about six weeks waiting on the final answer from my bank so maybe they will honour this. I'm relying on alot of maybe's eh?Well fingers crossed.Lorna0

You may qualify under the 'hardship' rule for your case to continue. You must inform the bank of this. More details in this link, near the bottom.

Just curious here, is there a reason why OFT had no problem issueing a cap on credit card fees but are handling banking fees a much longer winded way through the courts.0

Hi Martin, I claimed through the Financial Ombudsman Service and Lloyds agreed to pay me back. According to FOS they sent my agreement to the settlement back to the Bank. The problem is -How do I know if Lloyds received my consent letter, who do I contact to find out? Phoned FOS and got the recorded message, and on their website just that it will get pay but when? We know that the banks will try anything to stoll
Please tell me where to go to( Letter from FOS 17th July before this spanner has been throw in the works!0 -
If they OFT want to play that game, then we should ALL be refunded our court costs automatically AND for those of us who paid out the £10 cost for statements. Whats good for the goose ....
Why on earth are they sticking their necks out on behalf on the banks, whatever happened to the little people (of which I thought they were meant to protect from being ripped off!!)
Why are we expected to wait a year + for this to be sorted out?? This should be their main priority, people are angry at the way banks have exploited consumers enough as it is and for those of us that are in debt its just another kick in the ....
Just off the topic completely for a mo, why arent airlines being brought to their knees for the horrendous prices they charge during school holidays!!

Your letter should have told you, payment takes 6 weeks. Its only been 2.

Of course the person would be paid out their charges as their case had obviously come to a satisfactory conclusion, this is nothing to do with "keeping good relations with CAB".
Any offers that have been accepted must be honoured by all the banks.

Hi,
I wonder if anyone could help advise me about the situation now with the Financial Ombudsman. I have had complaints in about current account charges for over 7 months, during this time the banks largely ignored me and didn't provide me with information etc. Now FOS say everything is frozen and under no circumstances can they progress my complaints. I wondered how I will be affected by statute of limitations since I went through FOS and not court and if anyone knows of any circumstances where FOS must still investigate/pursue complaints? They have been advised of my financial hardship but say they can't help due to the court situation.
