isn't it funny how banks have now signed a "waiver" allowing them to suspend all complaints until the high court judgement, yet it hasn't suspended the banks right to go into your bank account and take your hard earned cash, for "breaching your agreement with your bank", that is not fair

All of the banks and building societies in the UK are covered by the test case. It doesn't matter whether they are actually a party to that test case. The test case will establish how the law applies to bank current account charges in general, not just the charging structures of the banks named.

please read my responses below yours mate, still learning how to work this site, cheers

Hi Martin!I spoke to someone on the phone from The Bank of Scotland on the 23rd June and was told that I would be given a re-evaluation figure within 2 weeks time. I take from your OFT announcement that this would now be put on hold. As I was given a date to be given some sort of offer of a settlement figure before the announcement was made would they not have to stand by their statement?I am not in a strong position for a long wait as I am off work on long term sick leave due to having had Breast Cancer so my financial postion is very shakey and getting worse as time progresses! I don't know what do do now!Any advise would be great.Lorna

If anyone at all can give me some advice about the above, that would be great.Should I phone the bank and try to persue some sort of answer tomorrow, or could this damage my case?HELP SOMEONE PLEASE!!!Lorna

Hi need some advise my parents have charges from 1997 to 2002 I know they are over 6 years most of them but since they have their statements already they have decided to go for it (like many people have).

With the OFT announcement should they still get their claim in now with bank, also would it be worth submitting the smaller of the 2 claims with the MCOL straight away,

    Pls advise

I have all relevant update information as i get it when it's hot off the press due to my job.

I've responded to your first comment, Marq, on other threads.

There has been no precedent-setting legal case which has shown that any individual banks' charges are illegal. There's no reason therefore for banks to cease charging in line with their terms and conditions.

The "waiver" from the FSA covers the banks' complaint processes and the intention is that court action will also be suspended pending the test case's results. This is a reasonable step - there is no point in 1000s more non-precedent-setting cases going to court whilst the test case is pending or in progress.

Still trying to learn how to work this thing, yep cheers bud very familar with all the above. The point was that whilst suspending compliants unitl the case as you have correctly pointed out is heard at the high court, they should also suspend collecting these very disputed charges as it would only be fair.

lorna anne today one of my clients was awarded £3542.89 in charges from RBS, so although they can waive, in order to keep good relations with CAB, they seem to still be paying out for now, although i have been informed this will stop soon.
