    Just an idea.

    If you have a claim already going through, therefore account in dispute. Could we draft a letter to the banks saying that because the account in dispute, no charges applied etc.

    I have a claim going through with Halifax and I got a default notice for this account (don't use anymore, but od balance due to charges). I sent letter ages ago saying that due to account in dispute, don't contact me until dispute settled, quoted harassment act etc. Since then, which has been a good few months, they haven't sent letters or applied any charges.

    Maybe worth a try, any comments.

    Hi this is my first post so please bear with me.

    I had two weeks left for Natwest to reply with an offer or refusal. My husband actually called them last Thursday 26th to ask how our claim was progressing and they said no decision had been made and they had until 14 Aug to reply. To say i was ticked off when i found out all this had happened on Sunday was an understatement. I telephoned Natwest on Monday and the girl said nothing had been frozen and to ring a different number and they could tell me what was happening, lo and behold when i called it was a recorded message saying that claims were frozen etc etc..

    I had already set myself up with a new account elsewhere and i am now in the process of changing my direct debits as i refuse to give the Natwest anymore of my hard earned money and i am only in this situation because they have basically pickpocketed my money in the furst place. I am going to change my childrens account as well. I will basically put £5.00 per month in the account to pay off the overdraft and they can have the rest when they decide to pay me back the £2290.00 plus the new charges and interest they have taken from me when this test case is heard.

    i know it's risky but unless i do this we are going to be worse off each month unable to pay more bills and i'll be damned if my kids are going to suffer because the Natwest are greedy.
  • I have followed the instructions re. claiming back bank charges. I am trying to claim on 2 accounts, a solo account of mine and a joint account with my husband. When we received the copy of the charges it came to a massive (to us!!) £4567.89 that is for the last 4 years. We received a final response from the bank prior to the new court case, offering us £750 as a good will gesture, however although I received a letter as well as a joint letter the money only went into the joint account. Is that right? I also then involved the ombudsman but obviously that is now on hold. My main query is should we have received 2x £750.00 for each account?

    Don't know if its been posted yet, but the court date is set for mid January to late February at the high court.

    No decision on bank charges before 2008 - Times Online

    I assumed that the High Courts must be busy until then. But they have since managed to fit the Manchester United/Tevez saga in for August.

    So us poor consumers are obviously not as important as the mega rich footballers.
  • Hi been trying to get my mums back charges back now for awhile.. sent a letter one month ago saying we will go to court if you dont pay etc.. they sent a letter back dated the 23rd july saying we will pay you £750..The full amount is £2050 so its quite abit less but my mum could do with the extra money..The letter said we will credit you account in 10 days with the amount as final settlement.. nothing for my mum to sign though.. I think if the banks lose this test case chances are my mum wont be able to claim for the rest..? correct??I'm thinking of writing to the bank today 01/08/2007 and word it carefully saying would you consider increasing the amount to £1200 and not mention anything about declining or accepting this amount or the other.. basically just asking.Any ideas or help from martin if your reading this thread?Many thanks

    i just wondered if anyone really understood what is going on with these charges? i dont really i sent my letter into the bank of how much i would like back, they would of got a day or two before the announcement, and now i dont know really what will happen? will they still contact me? will i have to call them ? is it on hold? please can anyone help me to understand all this.:o

    I applied to the courts on the 24th July and they served papers on Barclays on the 29th. Will my claim be put on hold or do claims that were submitted to the courts prior to the 27th continue?

    Wish I'd taken their offer of half what I was claiming now!
  • i havnt served papers just sent the letter asking for a reply in 14 days! but no word as yet. do u think it will all be on hold then

    You claim will continue as normal, it is the banks who have put claims on hold and you need to wait if your bank acknowledge or defend your claim.

    The bank will tell you they have your case on hold but you then need to file your claim at court if you wish to continue, please read Martin's article and the Emergency Guide here...
