I've had an ongoing claim with Barclays since March 07. I claimed £1649.35 (charges plus interest). They offered £760. I telephoned and said i would be requested a higher offer, they told me to put i writing. I used the template letter asking for £1050. They denied receiving the letter for at least a month. Half a dozen phone calls later i'm told th £760 was full and final - not stated in the original offer letter. Each time they said they would send me a new letter stating this was full and final - nothing appeared. My last phone call was 24th July, again they said they would send another letter to me - still nothing. I tried again today and was going to accept the offer however they have told me that as i verbally told them the original offer was not enough that this counts as a rejection and as a result of the waiver my claim is now on hold. Is there anything i can do - surely this is not acceptable?0

By issued I presume you mean you sent the letter to RBS? If you haven't sent them the letter threatening to take court action then do that now, if you have then you need to start court action. The bank can suspended or put on hold the claim but if you start your claim via the court route then it is up to the courts as to whether your claim progresses further but you need to get it into the system.0 -
Hiya could someone please explain whats going on as i am so confused with all this. I put in claim with MCOL its now at the aknowledge stage ans says the bank have 28 days so what does all this mean ??????

Your claim will be passed from Northampton to your local court and they will send you either a court date or further directions. It is up to your local court as to how your case progresses.0 -

I have been offered £1900 (asked for £2950) which I have recently sent a decline letter to. Are they still obliged to stick to their offer? also on the 27th, I had to pay a £100 allocation fee to the court or they would have struck off my claim. Can I get this back from the court?

Quick question for martin!!!! If the banks have stopped paying out untill the result of the court then surely they shouldn't be taking any money for charges either. how comes it works one way and not another!!!!0

Please can somebody tell me what HALTED means after the 28 day mcol period. It let me go for judgement then changed before I could submit.0

That's not what you asked before. If you want to know about timings on MCOL, read post 13 in the Reclaim Bank Charges Help Thread. In your case, wait for your bank's defence. And claims don't just stop automatically, the judge will have to stay them first.Reclaimed thanks to this site:
