    Dont know if anyone can help me or has any advice for me, but i started my claim at the end of April. the bank has drawn it out this long!! :angry: just last week i finally thought i was getting somewhere and they told me i had an offer letter just awaiting a signature & i would recieve this end of week or early this week at the latest. well as you are all aware, now the banks have put claims on hold and i have been told my claim has also been put on hold as i hadnt actually recieved the letter!! :mad:

    Where do i stand with this now? can i still take this to court? surely they are in the wrong for drawing it out this long!!?? someone HELP!!!:confused::confused:

    I have a case against HSBC started in March, which is in court on the 14th August, HSBC are defending the whole amount. I am starting to get nervous now as I have not even had a court allocation questionnaire and feel as if they have forgoten me. Do you think I should contact the courts, in light of just two weeks to go. Don't really want to go ahead with this now, just want my money back. Unsure if the case is still being heard because of the test case.
    Really confused, heard nothing from my bank apart from letters informing me that they are taking another £150.00 this month as well as the charges.
    Please can someone help / advise .

    Hi, just thought I would share my experience. Started claim with Abbey thru FOS in May. Had letter yesterday saying that they were prepared to offer £880 as opposed to the £1190 we claimed. Already got £70 back initially from Abbey at start of claim, before going to FOS, so not too bad. Says we have 2 months to accept and money will be in account within 6 weeks.

    If you are not told otherwise you can take it that the hearing on 14 August is going ahead. I am a bit confused as to what the hearing on the 14 August is for though so cannot be of more help as to what you should do in preparation. I would say that you should go prepared with arguments as to why your case should not be stayed pending the hearing of the test case.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    So even if we proceed with court cases against the banks whilst this test case is going on, then all our cases will still be put on hold until after the test case?
  • not being funny but if our claims are being suspended for now because of the oft making this test case then shouldn't that mean all bank charges should be suspended until further notice as well :confused:

    I have a question which I don’t think has been answered fully in Martin’s Emergency thingy. My account has exceeded its overdraft limit (by about one sixth of what they owe me) and now they are adding interest and charges to the tune of about 50 quid every month. If I wait until the court decision I could end up owing them ‘000s if it goes the wrong way and no doubt the b*stards will make me pay it all!!!

    What can I do? I have already started court action (case is due in September) so could I apply for a stay on the grounds that I am being charged all the time that the main test case is waiting to be heard?

    If so, should I write to the bank to demand that they stop adding charges to the overdraft (which is of their making!), in the sure knowledge that they will refuse to do so, and then present this to the court in support of my application (for a stay that is)?

    BTW Conor I read in the Times Online today that even if they have to repay every penny of the charges they have snatched over the past 6 years it will hardly even scratch the surface of their 40 BILLION QUID A YEAR profits.

    They don’t NEED to charge ANYONE for banking services because they make fortunes out of the interest on the money that everyone (sheepishly) pours into their coffers day in day out. Of course if the judgment goes against them, they will start charging not because they have to but because they can ‘cos, as you rightly said, these days everyone has to have an account . They’ve got us all by the short and curlies - wake up and smell the coffee you smug twit.

    That would be logical but is not what is happening. I am putting my thinking cap on to see if there is a way to force the issue.

    No as the Master of the Rolls before going on his summer holidays refused to make a direction it is up to individual courts to decide what to do it seems to be 50/50 at the moment. I suspect that one of the factors being used is how many cases will be affected . The more cases that a court has the less likely they are to stay matters. Also it may be a case of how peeved off with the banks behaviour the judge is.
