    I have spoken to my court today and they have told me they have recieved instruction that the test case will start this friday (3rd August 07) and all cases regarding bank charges are to be suspended until the outcome of that case. They have also told me to continue with my claim as normal with regards to paperwork etc and it will be delt with once the result of the test case has been given.

    On another note i received the usual £750 "good will gesture" from my bank a while back to which i informed them i would accept only as part payment etc, today i recieved a letter from my bank (Lloyds) informing me that they would deduct this from any final payment they may have to pay and that in any case they would not be making any attempt to reclaim this money should the test case go against the consumer. Some good news i suppose, least i can now spend it lol.

    Which Court was this and did they say who gave the instruction. I will make enquiries of my sources to see what I can find out.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    I am getting more confused - I have a case against FD at the end of August.

    Does FD bank have to apply for a waiver not to handle complaints relating to unauthorised overdraft charges, or should I still prepare my case?/////

    "Good" very clear statement of the current status of claims with FD First Direct Firstdirect. Most of this will apply to all other banks, I suspect. However you are advised to double check with them for their own differences in current status.

    First Direct Test case - Overdraft charges – Update

    Basically, everything is on hold. They won't process any more claims, they will apply to the courts for a stay of proceedings and they expect the OFT case to take at least a year.........

    i've just called the court as we have a court date of 21st august, they have heard nothing and they say that the appearance will go ahead as planned.
  • All i know is that , out of my claim against the Abbey for £4125....I am now only getting £1906.
    I went to the FOS as Abbey chose to ignore every letter etc and not send the statements through.It took 6 months to get statements. Everything was fine with the FOS and they agreed with me over the phone and in writing that the treatment we had , on the surface of things...looked unfair.
    Next minute...this announcement comes out....I get a letter from FOS saying that they are no longer treating these cases in the same manner and advised me to take the settlement figure of £1906. They even ditched the guy that had dealt with me since last June and the new guy was practically saying that this is all I would get...no 8% interest and only a percentage of what i was owed.
    On top of this...abbey reckoned I owed them £4266 which was ridiculous and because they say that i owe them money...the £1906 will be applied to the account to " reduce my debt" when they owe me money!!! So now I have to deal with debt collectors etc. Its a nightmare.
    I did manage to get £200 out of Capital One without too much hassle...the Natwest are ignoring me...but the Abbey practically ruined me last year and it looks like they have gotten away with it.

    What is currently going on with bank charges I have heard loads of stuff like claims have been put on hold etc can you still claim?

    Conor, isn't the issue here that the banks are charging fees which exceeds the actual cost to have it processed and not that we do not want to pay the fee? I have never disputed that a fee should be paid as long as it is reasonable and covers the banks processing costs. That is what the argument is all about. Naturally, I would not want to see free banking disappear but at the same time, why should it not be free banking in the first place. To my knowledge the banks have the privilege to 'play' with our money in stocks & shares and god knows where, and gain a substantial profit from this. In the end the banks are just greedy sods and think that they are above it all. It is about time that the consumer is treated with respect and not treated like idiots. Thank god for all the available consumer rights information as this is probably the only way us 'little people' can use to our defence!!!
