    hi sounds as if the banks are going to use every trick in the book to prolong this action as you know when anything like this goes to the high court, it is dragged out for as long as possible, costing millions for the barristers, I still want to know if the Judge orders a stay until the oft case is resolved which could be years, is he not condoning the banks use of our money, which until this happened would probably been paid back to us? what about the huge profit on investemnts they would make? If the Oft win the banks have surely used that money unlawfully?

    Hi All, i know i posted in this thread yesterday and some where awaiting on the outcome of my preliminary hearing. I had my hearing this morning against A&L, the bank did not turn up to defend and the judge was lovely, he even worked out extra interest i was entitled to as i had only calculated up until the date i filed my claim in April. He ordered that A& L should pay me the full sum within 14 days. The judge was lovely, i was nervous about any questions he may ask as i didn't know what to expect, but i didn't have to answer anything, i don't think he was too happy at the bank wasting his time. He did ask though if i had been in touch with a&L and i told him i had tried to negotiate with their solicitors but they told my their client did not wish to settle.Don't give up and let recent media cover put you off, i was so nervous last night and this morning but it was all worth it in the end, (well i will be waiting to get that cheque before i really celebrate - they have 14 days in which to pay my the full amount claimed, which is just short of £3.5k)Thanks for all the support on this site xx

    This is good news especially after the news this morning that the Judge at Southend has apparently stayed all the cases in his Court. So it looks like the county courts are doing what they think.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • Thanks Martin you are doing a fantastic Job, I am a little confused however, does this mean that people who have already sent the third letter threatning to take the bank to court, will not get their money do we continue or what do we do next ?

    I have rang solicitors representing A & L who had made me an offer the day before announcement by oft .I had declined their offer but have asked if they have suspended all claims, can I change my dicision and accept their offer. I am waiting for a reply as the solicitors had no idea what A & L were doing either

  • Ok Sorry if this is in here twice, First of all thanks Martin you are doing a great job, secondly I would like to know what to do next I have just sent my third letter to Barclays Threatning to take them to court if they do not refund the £ 2300.00 they owe me, so what do I do now, does this mean I won't be getting the money back ?

    You start your claim via your local court or MCOL on the 15th day if you have no reply from Barclays!

    Thats good news nadish:j I have to say that has cheered me up a bit....I just got off the phone to the Court Manager at Southend who was really nice compared to her ogre staff that have practically ruined my day!
    I have now got a NH22 form (I'm sorry I can't remeber the specific form) on its way to me where I can ask the court to review the stay for £65. Thank you so much Stokey you have really helped me today x:money:

    I am going tio keep going especially as it looks as if some courts are trying to put a spanner in the works. They know that many people will not know the leagl terms or which particular form specifically you need, but to tell me £120 to appeal when it really could be £65, shows exactly where they are at unfortunatly.......Oh yes...if we don't know, and people get put off with the £120 price, the workload goes down at the expense of.....me:rolleyes:

    I didn't ask for any costs, didn't want to get too greedy, was just grateful that it all went ok. I was so worried after all the media, thanks for the links yesterday Edinburghlass, i had a good read through them last night, i think my brain was going into overdrive xx
