I don't know whether they can do this or not but I urge anyone to keep away from these vultures who just cost you more money, while you could easily do it yourself, especially if you are on benefits and would not have to pay court costs. You could maybe ask your local CAB for advice.
    Reclaimed thanks to this site:

I put in to reclaim my bank charges with a no win no fee company called Bank Smart only to receive a letter today saying that I hadnt paid enough charges so I got a bill for £117.50 inc vat
Can they do this - do I have to pay as I am disabled on DLA and I only get £439,00 a month to live on Regards star10463

The answer is in the name No Win No Fee. They havent 'won' you anything therefore no fee payable. It is very odd that they say you havent paid 'enough' charges to be able to reclaim. Even one charge is worth reclaiming.

Check the terms and conditions, and all small print, of any agreement you signed with them to see if there are conditions attached to whether they will only act on your behalf to reclaim charges worth over a certain amount.

If there is no such condition and they have stated that they will reclaim your bank charges regardless of the amount they have broken the agreement.

Until you clarify that they have fulfilled your contract then I would not pay the amount demanded and would state the agreement is in dispute until you can fully check all the details. I would want a full statement of all work they have done on your behalf to justify any costs to yourself.

Without knowing any more details its impossible to advise you further than that but good luck :)

Surely if it's a no win, no fee company - unless they got your money back you pay nothing!

That doesnt excuse your negative actions and my advice on dealing with such queries in future still stands. You have been dealt with fairly and with good grace on the forum and I simply suggest you show the same courtesy to others.

Can we force the pace of this court case?
Petitions, letters to MPs, How much are the barristers being paid whilst no progress is being made, etc.

We as a body are bigger than most. Lets bully them for a change!
  • Do I pay the rent + Rates or bank smart for next month they were meant to take 10%m of any winnings as paynent which I wouldn't have minded and wouldn't complain about

The short answer is NO as we are not a party. In any event with Vacation starting tomorrow there is no chance of a hearing before October at the earliest and probably even later as cases would already be listed to be heard in the period October - December. It should be noted that the barristers are not being paid in relation to this matter unless they are doing some work in relation to it.
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
