    Now you seem to be a bit calmer I'll try and answer your question, we are not the enemy here and I really don't appreciate the fact that the swear filter has had to moderate your post :)

    As you have had no answer to your letters then yes, you need to start your claim without delay.

    on the announcement it says they all court cases will be suspended?
    am i right?

    or are they still putting the motion through to suspend, so if i put in a claim now, my claim will still be valid in the queue ?

    lloyds owe me £4000 in charges, i really need the money,

    please advise

    MCOL is back on.

    At 00.24 i requested judgement by default for a friend. Today is the 29th day (it was sunday, but they get another day).

    The other side will no doubt file a late defence today, and MCOL will accept it, as late defences take precendence.

    Fingers crossed anyway.

    I have to ring court in Morning for my own default.

    is it worth me putting in a claim online now?

    the 14 days were up on 27th July for the bank to respond to my court letter threatening claim.
    with this new suspended ruling,

    shall i still put in an online claim ?
  • My partner went to court today for £900 from HSBC, they did not defend nor turn up and she won. I dont think the banks have any power over the courts, if a case is already in the system.

    THe charges are for an unauthorised overdraft (which you would have if they allowed the DD to go through). THis is always the catch 22 situation as you may also get charged by the company you were trying to pay for a failed DD!!!

    Whats the charge for when they bounce the payment tho? since its bounced you are not in an unauthorised overdraft.
  • Following these boards and making a claim myself (£2,300 from Lloyds TSB) but saddened and shocked by the latest news. I've been away for a few days and back now and everythign seems to be a bit of a mess.
    After a lot of reading it seems the future looks a little bleak, with things leaning a little in banks favour (allowing them to put everything on hold).

    I had so far in the process..
    1. requested details..
    2. sent 1st letter
    3. sent 2nd letter

    Next was moving to make a court claim, can/should I do this now?
    Was about to create thread to confirm a few things (check list) before starting the court thing but should I bother now? I'll have to stump up the cash for the court then wait for well... forever to find out what happens next, which I'm guessing will go in the banks favour...
    or..
    At this point in my claim the bank has already pushed me to the court process. Therefore is it now in the courts hands (once I present to them that is) i.e. can the banks do anything about it now?? are the courts on hold?

    Confused... to much reading of other ppls posts has me confursed about my own claim :( any help/advice please...

    Just seen the programme that Martyn appeared on i'm not pleased nearly there with the bank now accounts are frozen ?? until they sort this it has took me months of waiting to claim the money back. I think if the banks win and we don't get our money back it stinks as they have paid out so many already my friend got hers 2 weeks ago if they are paying out then they are suggesting something is wrong. I'm hoping this gets sorted very soon, as someone said on here it is a wrong thing to do,no matter if you have money or not never mind irresponsible.
    Sorry for the rant guys but it gets to me, well done Martyn for telling that lady that consumers do count.

    Call me cynical, but I reckon the deal has already been done and the court case is just a show to make it look like the OFT is still on the side of the "little people".

    I would be very very surprised if we win the case, the look on martins face suggests he may also be suspicous. A decision to goto court without suspending charges in the meantime done behind closed doors, the government will not want the banks to lose because its in their interest for the banks to keep the profits and the judge may well have a vested interest for the banks to win the case, generally wealthy people stick together. I dont think the banks will necessarily get an all out victory but they are not going to be told what they done is illegal and then to automatically pay back all illegally claimed money it could create serious consequences to the economy as they would need to find the cash quickly and get it from businesses etc. that they invested in and would then start charging for ATMs etc.
