    I understand this test case applies to overdraft charges, but what about returned direct debit charges?
    My overdraft charges are only a tenner, but my returned direct debit charges are £38, so this is what I really care about

    Quick question if anyone knows the answer. If this test case is going to take up to a year. What happens if you are waiting for an offer or rejection letter. I have been waiting a month for the HSBC. If this is going to take a year and most of our cases are on hold till the outcome. Would we lose the frist year of charges ie 6 years ago?

    Yes you would at present as far as I am aware the Courts are dtill accepting new claims so you may wish to commence proceedings to preserve your position
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Sorry Tonus! I was told all the same thing. returned d/d were all I was claiming. Dammmmmmmm!!!! £1500 worth....

    Hi Izzy,
    I think you are probably right about the offer being made before the 26th,(according to an earlier post from Edinburghlass the bank have to pay up as they have agreed it with FOS). Have sent off my acceptance today so watch this space maybe we'll be celebrating at the same time:) Good luck.

    My question therefore to my above email is: does this mean if you receive child benefit that you can continue your claim or do you have to qualify for all these?
  • A repky for Angelwillow, apparently credit card charges can still be claimed.

    I rang my bank today not knowing all this had gone on, it was the end of the 8 weeks for me today so this leaves me wondering if they were going to pay me anyway? Surely they were at the end of deciding my claim.

    I cant beleive it, the bank has told me this court case will go on for a year??? so i wont get any money for a year?? Does anyone know if this is an about right time?

    Seems to the be the case babycakes - but who knows how long!!! However, I would contact them to find out for definate that they are not paying you. Then the general concensus seems to be to take them to court anyway. Most courts are still going ahead as normal and until that time at least you are in thesystem. So well worth doing! I am prob about a week behind you, and of course have heard nothing. So have emailed them for clarification. Then I am going to the courts. It's not the end yet!!!!!!!!

    Can anybody tell me what the cost of the MCOL would be for a claim for £1500 plus int? Also how would it be best to put this amount through as obviously if it goes to court it will incur interest and charges and therefore be quite a bit over the threshold. Any advice appreciated.
  • OK I am getting judgment by default on Wednesday (I hope) but I have a question from a friend who is about to file.

    The FSA have told the banks they no longer have to process our requests, OK fine well no change there as they never did anyway. As the FSA can't direct county court judges in matters of law if we proceed to court anyway we have 3 possible outcomes:

    1) We win as usual
    2) The court grants a stay pending the high court test case, unlikely as the courts are sick of the banks wasting there time and so far all the feedback is they won't grant stays
    3) The Lord Chief Justice himself orders a stay

    Forgive me if I am missing something but unless the L C J sticks his nose in then all the banks got was a cheap stunt to try to make people simply give up, in actual fact very little has changed here. Have I missed something?
