On Monday of last week money claim ruled in my favour and made a judgement against Alliance and Leicester.

Once again they have ignored this and when I rang the bank today they advised that this had been put on hold pending the landmark case we all know so well.

Can they do this? A descision has been made prior to the 26th on the 23rd?

Do I issue a warrant? Am I just wasting more money?

How can they legally do this?

No they can't do this but to be fair to the person who answered the phone they are probably working from a script and are told to say everything has been put on hold.

You probably need to give them 14 days from the date of judgement to pay the money and if they don't then you need to to issue a warrant. I would write to A&L today to tell them this is what you plan to do.

It is a standard fee payable under a fees order I have never been able to work out the rationale behind fees charged. I believe the reasoning goes that it covers the cost of the judge looking at the papers and making the order. However the fee is the same regardless of the size of the documents that have to be read.
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

The fee is only payable though if the claim is more than £1500.

If Nadirish can keep us informed this would definitely help.

I have just received and offer from Halifax (lot less than claimed). Would like to go to court. Phoned the Local County Court today and told in a roundabout way that it depends on the judge whether you will get a hearing.

    Not sure how to proceed.

Don;t worry i shall let you all know of the outcome straight away, i have just called a and l's solicitor to tell them that the court said business as usual and would they like to accept my reduced settlement offer before court, i'm waiting on them getting back to me, think i know what the answer will be!?

How is this decision likely to affect me?

I wrote to Halifax around 3 months ago about 2 charges on my account ammounting to around £65 inclusive of interest. The first response was the usual charges are fair etc. I sent the 2nd letter threatening court action and heard nothing.

I was about to initiate an MCOL claim last week when a letter dropped through the door offering me £125 as a goodwill gesture.

The letter is dated the 19.07.07 and states that the payment will be sent to my account within 14 days which from my calculations is 02.08.07?

Are Halifax obliged to make this payment in light of recent events?

To my knowledge A&L and/or their solicitors have never turned up to a court hearing yet. :D
