PLEASE NOTE. THIS IS NOT A THREAD FOR DISCUSSING THE RIGHTS AND WRONG OF RECLAIMING. THERE ARE PLENTY OF OTHER THREADS FOR THAT.

PLEASE KEEP THIS THREAD TO SUGGESTED QUESTIONS THAT WE NEED TO KNOW THE ANSWER.

E.g. (more for my own notes than any other)

    i. Will court fees be refunded via MCOL if cases won't be heard.
ii. Will cases currently scheduled still be heard
iii. Will cases that haven't been acknolodges via MCOL still go through
iv. What will happen to cases that have already been put to the FOS.

The hearing is more than likely to still go ahead so you need to prepare to attend and take along anything the court have asked you to.

Does this recent test case mean that catalogue charges will be included or is it safe to go ahead and approach them for my money back. Thanks

Still OK to proceed at the moment, as it only applies to current accounts.

I have my premlinary hearing tomorrow, i have just called the court to confirm that it will still be going ahead and they have said yes, so i wonder what they will say tomorrow, do you think it will make any difference that my bank isn't one of those involved in the test cases??

No let us kno what happens also if there are any other bank charges cases whether they get suspended. This will be the first opportunity to get an idea of what the courts are going to do especially after teh Brennan decision this morning.
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • This morning my daughter phoned her bank regarding a new charge for goin overdrawn. at begining of the month she went to an ATM did a check on how much she had in acount before going into shop. She was told she had £22 in acount and her available amount to withdraw was £22. She went into shop and paid £17 on her card (this was a Saturday). On the monday £150 regular payment went into her account. Today she gets a letter telling her she is going to be charged £25 for going overdrawn she phoned bank with reciepts from Atm check in hand clearly stating she had £22 available. When she challenged this and asked for the £25 penalty to be waived she was told she could not querie this until after the high court judgement and no charges can be recindered due to the agreement to susspend complaints procedure. Can this be right sureley the complaints procedure has only been susspended regarding those reclaiming charges over a period not individual charges incured now. anyone else any thoughts on this.
  • If Nadirish can keep us informed this would definitely help.

I have just received and offer from Halifax (lot less than claimed). Would like to go to court. Phoned the Local County Court today and told in a roundabout way that it depends on the judge whether you will get a hearing.

    Not sure how to proceed.
now that don't kill me, can only make me stronger.
