    We have had all the claims put on hold, but the banks will still be able to steal more money from us in the meantime.:mad:


    Your right the banks have made it clear on thier websites that they will still be leveling theese charges. One possibility is for those who have claims still going through the courts as these have not been suspended at the moment
    if the bank asks to suspend the claim pending the result of the test case only agree if they also agree to suspend imposing charges on your account. If they do not agree then say let the court decide. See the thread on arguments against suspending claims for possible arguments to use at court.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    This has been standard procedure from NatWest and RBS for months and generally everyone who has given them the 6/8 weeks have received an offer of the full amount in the timescale without having to take court action.

    You'll need to send off the next letter giving them 14 days or you will start court action or you give them a week until we see how they are going to be dealing with claims now.

    The last letter I sent was the one giving them 14 days. Have I made a monumental mistake in excepting their statement that they required 6 - 7 weeks instead of being firmer and sticking to my original threat of 14 days? I can't implement the next stage now can I ? Should I give them a week as you suggest to see if the picture becomes clearer? Edi

    I Sent my allocation questionnaire on 29th june, I am still waiting for a reply, I have phoned to see the outcome, but get told its with the judge and to phone back in a couple of days. Which i have done 4 times now to be told the same. Is this due to the news or is this normal to take this long. It has been going on for so long now started this in feb, just want it to end.. Any advice for what happens now which the lastest bank news

    Just a thought, if we win this, which I think we will, does the intrest that we will be claiming contiunue to the date of the outcome or will it be capped at the amount within our claims statements?

    correct...you will still get your fee and interest at the daily rate....i,ve already calculated mine should it progress up to may 2008, nice tidy sum too.

    carry on as normal Edi as if nothing has happened, your claim will be logged on the system then it will be on hold..
  • if i get any more charges put on my account i will make sure my wages go in to my new account and i will tell barclays im freezing my account and overdraft,if they send me any letters requesting payment i will ignore the first few then reply to later ones saying i will endevour to correspond in 6 weeks like they did to me,i will ask for a accurate costing of bank charges explaining not their currant fee`s but a true cost if i dont get one back i will then give them martins figures i will then work out the number of charges on my account in the last 6 years and muliply it by about £1.50 i will then send a letter back offering the ammount (probably about £90.00) as a good will gesture with no admission of liability enclosing a signed returns form (like i got) and i will state if i dont hear from them in the next 8 weeks i will deem the matter closed,if they take me to court i will go and say i intend to pay when the official judgement is give of the costing of bank charges...i`m gonna play them at their own game using the same dirty tricks and see how they like it,.. i was on the verge of court andit would of been settled by now if they had not messed me about

    You shouldnt break your contract with the bank, even though there is a dispute on you should maintain regular payments into your account, but it is your decision.
  • Tell the bank you will pay them, as long as you pay at least £1 a month there is nothing they can do. You are showing willingness to pay.

    Could the CAG-MSE fighting fund £100K be used to take the FSA to task over the direction to the Banks i.e. stop the charges during the litigation and the imbalance created due to statute of limitations act.

    The press did not make it clear to the consumers that: Only a Judge can decide a claim in court despite what the banks are telling the claimants when they call!

    If MCOL and the County Courts refuse to accept claims then, there is a clear breach of Human rights issue.

    It should be business as usual and keep filing claims so people do not lose out on the interest or the statute laws i.e. 6 years as, any action by the OFT could take 2 years or more.

    IMO: We will end up with the same deal as the credit card companies £12 being a so called cap. The Banks auto refunding £8 of any charge then, the end of free banking to recoup their charges.
