How will the timescale work after an agreement has been reached. Will my claim still be from the original date ( 5 years). I'm in Scotland and started my claim in April. The claim is from April 2002/2007 The test case could easily add on nearly another year.

If the courts were to rule in favour of the banks, in theory that would give banks carte blanche to put their charges at any level they liked. How likely is it, in view of the OFT's concerns about the level and scale of charges, that courts will rule in the banks' favour? Not very, I believe!! We need to keep our nerve and keep up the pressure on the banks. Everyone who has not yet made their claim should write to the banks concerned informing them that they intend to pursue the matter, subject the the judgement.0

I am not sure when you say that you are in Scotland that means you are living in Scotland and you issued the claim in Scotland or That you are visiting Scotland and issued in England. In the former case the discussion is complicated by the fact that any decision in the test case will not apply in Scotland as the High Court in London does not have jurisdiction over Scotland. It only applies to England and Wales I am not sure if separate action is being taken in Scotland.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -

i'm a little worried, i'm in the middle of claiming my unlawful bank charges back but after the banks going to court on friday someone told me that they have frozen all bank charge claims. can anyone give me an update on whats happening pleaseeeeeeee

If you have an ongoing court case then it is still going on there has been no reports on any of the threads of any court suspending claims. It would seem reading between the lines that the district judges in the county courts are not suspending claims so for now they go on and the banks will have to apply to have the claims suspended.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0

im in the process of claiming charges back from capital one credit card ,does anyone know if the recent announcement affects this reclaim of charges ,i am under the impression that the oft agreement was only with a certain number of banks,any help on this,thanks0
