    We filed with MCOL against Abbey on 16th July for approx £2300. They have until 4th August to reply...does this mean that if we don't hear anything from the Court or Abbey between now and the 4th we can enter a judgement by default?

    Glad to hear that Credit Cards are unaffected by the Test Case...watch out MBNA here I come!!!

    Yes but as the 4th is a Saturday, they will be given the Monday as well to respond - and they might well use it.

  • I'm with the natwest and started my claim on 10th June threatened court action 2 weeks ago was due to file this week. Does anyone know if a court date has been set for them and how long the process could take? Also being with NATWEST and this wasn't included in the list of banks going to court will it still be put on hold??

    If you have not commenced proceedings you can still do so.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • Sorry, but the terminology is UNLAWFUL. Payment system will be changing soon. I think we will be paying for bank accounts soon. I have believed this before MSE started a thread on reclaiming bank charges.

    I can't imagine many of us could argue greater harship... THat lot is never sympathetic as a group, but it is really worth trying. You're obviously trying to carry on as "normal" and I wish you the very bewst of luck with everything! x
  • Hi, I was about to file at court for a claim against Natwest as I have had no reply from my LBA. With the Test case stuff going off I did not know if I should file a claim with the courts? or write to FOS under the Harship waiver? I am a single parent caring for 2 disabled children and the bank charges applied were taken out of my benefits, this was my only income paid into my account.

  • I think we need more information as to what classes as a Hardship case.
    I have not worked for NatWest Bank since February 2009

    What will happen to cases that are already in the hands of the Bailiff. I have received a Notice of Warrant dated 24th July. Will this be executed, if not what have I paid for?
