    We received an offer from RBOS on Wednesday of last week and signed the acceptance offer then, posted it on Thursday morning - using our own 1st class stamp rather than their 2nd class reply paid. I did note that the letter was dated 19th July but took that long to get to us - again 2nd class post.

    I am hoping that they will pay up as the offer was made and accepted prior to Friday - but I can't find any info on this anywhere - not even on the link previously given. Eeeeekkkk - great timing OFT!!

    Will Halifax make the payment within their own 14 day timescale from the date the letter was written or will they add 3 days to account for delivery?

    Just to add, I wasn't required to take any action to accept the offer. If I wanted to reject, I would need to return payment and contact the individual dealing with the case. I take it this will not affect things either?

    Short Background:-<O:p</O:p
    Barclays offered me about 1/3<SUP>rd</SUP> of my claim. I said no, took the online court claim route. Paid £80 to the court, bank acknowledged my claim at the last minute meaning I have longer to wait(Now due 06.07.07). Meanwhile the FSA have nonced everything up for hardworking claimees like me!<O:p</O:p

    1. If these claims are on hold who keeps the money I paid to the court in the meantime?<O:p></O:p>
    3. Claims court/FSA/ Banks have not told me my claim is on hold? Will they when I click the button to request judgment?

    1. I wondered if anyone was suing for loss of interest/financial damage due to the above scenario?

    2. Surely someone will sue the FSA for not being independent and causing consumers financial harm?

    A preliminary hearing is really to decide if the cases should go forward to a full hearing so if A&L don't turn up you stand a good chance of the judge awarding you by default. Have a read of this thread regarding Preliminary Hearings.

    hello, if i were to get to the stage where i could press the judgement button on mcol because the bank has not defended would i still be able to go ahead with this and what do you think is the likelyhood of getting the money once this has happened?

  • Thats fair enough but It may have been sent to me but I thought it would benefit members of this board as well to help people with there claims!!!!!!!!!!!!!!!!!!

    Yes you should still be able to go ahead and the judgment would be enforcable so you should get the money
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Hi there,

    Can you tell we what effect Nat West winning the case today will have on the rest of us trying to claim back bank charges? Is it all over for us?

  • hi,can any one help me with my query, im at the stage where i recieved an offer of my bankcharges+interest being offered and accepted on 26-07-07,i signed the agreement and returned the agreement the same day by recorded delivery,with the pending "test case",do lloydstsb have to honour this agreement or do i have to wait for the outcome ?........... please advise if you can to my next steps to take ....thanks
