Thanks for posting that email but wondered if you or anyone could help. I am in the very early stages of reclaiming bank charges, i.e getting bank statements and am so gutted at this decision... Should I write to the bank asking for my charges back once I get my statements so it is lodged or should I wait until after this test case finishes? I'm with barclays and they are one of the banks signed up to the case. Really annoyed at myself for waiting this long to claim only for this to happen. I'm also pretty sure I have lots of charges from my credit cards - but where do i stand in claiming these as i'm paying them back through the CCCS? Thanks for your help!.... DDMP Nov 05 =£20,293

no that does seem to be good news if like me the only things that get paid into your accounts are
child benefit
csa payments and tax credit!!
thing is how the banks will react to this or wether they wil jus ignore it and treat is the same as the others ....:money:0 -

I have started a claim with Barclays bank for claiming back late payment fee charges, the thing is that a couple of month before i was late with the payment, i had done a balance transfer with them and they charged me a fee for transferring at a special interest rate, but when i was late with the payment they stated charging me the full rate, so i did not get the low rate for the length of time that i was supposed to, so the question is can i claim this fee back from them.

Most people will tell you, don't stop following the procedure. They have not won yet! Carry on and get your statements and work out your charges, then follow the templates for your claim.
As yet the courts have not stopped hearings, so unless this changes it's business as usual. Should you put a claim in and the situation changes then at least you are registered in the legal system and have a place in the queue. Also as the statute of limitations is 6 years - this means that if you claim for 6 years from now and get stuck in the system, then you can still claim back that far. Otherwise it starts from the time you submit your claim. So potentially you could loose out on a lot of money.
So personally, I would say go for it and use this site for support. All the best.0 -

Bank: Lloyds TSB
Just wanted to share my news, I had sent my letter threatening court action last week and have received a letter today, dated 26 July informing me that they expect their enquiries to be completed by 10 September 07 but they will try to get me a response sooner. With the letter dated 26 July I am assuming that this is taking into account the recent news with test court case? Well, I thought it would be later than September before we would know the outcome? Suppose will have to wait and see, fingers crossed.

I phoned my bank today (RBS) to find out if the offer that I had recieved and one that I was accepting, was going to be paid out now or did I have to wait a year until this OFT Hearing was over. I got speaking to a really nice girl who said that if my acceptance letter had been recieved before the 24th of July then they would pay out now. If however it was recieved after the 24th, any monies due would be paid out after the year!!! I was then transferred to a Rachael Smith in Edinburgh who informed me that once again they would be making an offer to me but unfortunately it will be after the test case and not a minute before as they have been instructed to put ALL cases on hold until they had the official outcome!!!I was one of the unforunate people who is still due them money (but, not nearly as much as they are due me!!! One is a business account (which has been paid out - yet no-one can tell me where the money has been paid to!!!)and the other is a personal account which is the one that the money is on hold for!). I asked what would happen now and explained my situation with regards to paying them back the money that I am due them and she said that as yet she had never had to deal with a situation quite the same as mine and that she would try and find out where the money that had been settled had gone to and she is also finding out what happens with regards to freezing any interest that I might be due them in the next year. Needles to say I am still awaiting her reply on that one but the minute that I get any sort of answer I will let you know what happens!!!If needs be, I am more than happy to take it all the way to court just to see what happens (I get my court costs paid anyway as I get Tax Credits so I really have nothing to loose!!!).Good luck to everyone else and here's hoping that you get a bit further than I did!!!</p>!!!!!! happens!!!:D0

I was able to ask for judgement by default last Thursday as the Halfax had not entered a defence within the 28 days. Then on the 29th day after I had asked for judgement they entered a defence. How unfair is this?
Same happened to me with Barclaycard. Its a joke, that a late defence takes precedence over a timely judgement request.0 -

I find this a bit funny, regarding the acceptance before 24th July, as I received an offer today, through the FOS dated the 26th July. Another poster also had the same letter today and was advised by the FOS that his offer would be paid out within 6 weeks. ( I was too late home to phone the FOS, but will phone 1st thing in the morning,
